Narrative:

At approximately YY15 local, my student and I were instructed to hold over the mlb VOR at 3500 ft, south on the 180 degree radial with left turns. As we were holding, I heard another aircraft approach the area with a vector of 270 degrees to fly around an aircraft holding over the VOR at 3500 ft which was us. I cannot recall patrick approach notifying us of this traffic. Approximately 5 mins later as we were turning inbound to the VOR, I saw the other aircraft at our 12:30 O'clock position and lower, approximately 100 ft flying away. At that time patrick approach tried to reach us. The controller told us he tried to reach us twice without response. My student and I cannot recall approach calling us. I believe the controller forgot us because he was handling a passenger jet that was inbound to mlb. Upon the near midair, I requested to terminate holding. As the safety pilot, I did not see the traffic nor did I hear the aircraft approach the protected area of the holding pattern. Since he was lower, I think the low wing design contributed to the inability to see the other traffic. Supplemental information from acn 359742: fully occupied in the cockpit with my training, my instructor was watching visual for traffic. Just entering a left turn for 180 degrees, I heard patrick approach call out to another PA28-161 that I was holding on 180 degree radial at 3500 ft. After completing my 1 min leg in the 180 degree radial, I made my left turn inbound on the 360 degree radial. Turning left, I completed my 180 degree turn to 360 degrees and when I rolled out of the turn, I noticed out my left front window there was a PA28-161 approximately 25 ft below my holding pattern. He was aiming straight at me with no intention to avoid a situation or traffic whatsoever. Approach warned the traffic of our position and flight pattern. He was to avoid us and pay attention which he failed to do. We then got a call from approach and they knew nothing about the close encounter. This situation could have been avoided if the other party paid attention and listened to our position and avoided it. I honestly cannot think of anything wrong that we did or could have done to avoid this situation.

Narrative: AT APPROX YY15 LCL, MY STUDENT AND I WERE INSTRUCTED TO HOLD OVER THE MLB VOR AT 3500 FT, S ON THE 180 DEG RADIAL WITH L TURNS. AS WE WERE HOLDING, I HEARD ANOTHER ACFT APCH THE AREA WITH A VECTOR OF 270 DEGS TO FLY AROUND AN ACFT HOLDING OVER THE VOR AT 3500 FT WHICH WAS US. I CANNOT RECALL PATRICK APCH NOTIFYING US OF THIS TFC. APPROX 5 MINS LATER AS WE WERE TURNING INBOUND TO THE VOR, I SAW THE OTHER ACFT AT OUR 12:30 O'CLOCK POS AND LOWER, APPROX 100 FT FLYING AWAY. AT THAT TIME PATRICK APCH TRIED TO REACH US. THE CTLR TOLD US HE TRIED TO REACH US TWICE WITHOUT RESPONSE. MY STUDENT AND I CANNOT RECALL APCH CALLING US. I BELIEVE THE CTLR FORGOT US BECAUSE HE WAS HANDLING A PAX JET THAT WAS INBOUND TO MLB. UPON THE NEAR MIDAIR, I REQUESTED TO TERMINATE HOLDING. AS THE SAFETY PLT, I DID NOT SEE THE TFC NOR DID I HEAR THE ACFT APCH THE PROTECTED AREA OF THE HOLDING PATTERN. SINCE HE WAS LOWER, I THINK THE LOW WING DESIGN CONTRIBUTED TO THE INABILITY TO SEE THE OTHER TFC. SUPPLEMENTAL INFO FROM ACN 359742: FULLY OCCUPIED IN THE COCKPIT WITH MY TRAINING, MY INSTRUCTOR WAS WATCHING VISUAL FOR TFC. JUST ENTERING A L TURN FOR 180 DEGS, I HEARD PATRICK APCH CALL OUT TO ANOTHER PA28-161 THAT I WAS HOLDING ON 180 DEG RADIAL AT 3500 FT. AFTER COMPLETING MY 1 MIN LEG IN THE 180 DEG RADIAL, I MADE MY L TURN INBOUND ON THE 360 DEG RADIAL. TURNING L, I COMPLETED MY 180 DEG TURN TO 360 DEGS AND WHEN I ROLLED OUT OF THE TURN, I NOTICED OUT MY L FRONT WINDOW THERE WAS A PA28-161 APPROX 25 FT BELOW MY HOLDING PATTERN. HE WAS AIMING STRAIGHT AT ME WITH NO INTENTION TO AVOID A SIT OR TFC WHATSOEVER. APCH WARNED THE TFC OF OUR POS AND FLT PATTERN. HE WAS TO AVOID US AND PAY ATTN WHICH HE FAILED TO DO. WE THEN GOT A CALL FROM APCH AND THEY KNEW NOTHING ABOUT THE CLOSE ENCOUNTER. THIS SIT COULD HAVE BEEN AVOIDED IF THE OTHER PARTY PAID ATTN AND LISTENED TO OUR POS AND AVOIDED IT. I HONESTLY CANNOT THINK OF ANYTHING WRONG THAT WE DID OR COULD HAVE DONE TO AVOID THIS SIT.
