Nov xx 1996 I did a combined photo and demonstration flight from french valley airport, F70, in an R22B helicopter together with passenger #1. Our mission was to take some photos and do 4 demonstration flts with his brother, passenger #2, at his house in laguna nigel. We departed XA30 in the morning and arrived at the house XB00. Passenger #2 was the first one up in a demonstration from his house to dana point at the beach. Thereafter I took up 2 of his friends and his son. The same route, down to the beach at 500 ft AGL and back. I did 4 X 10 min demos following a road that leads down to the beach. After my last landing, a hughes 500 helicopter circles over us and mins later 2 police cars arrived at the landing zone. They checked my license and accused me of not communicating with the police helicopter, and not communicating with el toro tower, and of flying too low over dana point and being only 50 ft over the houses on my approach to the landing zone on cul de sac, mountain or hill. They also said I had violated the special flight rules area. Both me and my passenger did not hear anybody talking to us, except one pilot broadcasting with el toro traffic, and one person saying that el toro tower was closed. I called el toro tower 5 times before entering the area in laguna nigel, but the tower never responded. The airspace is class G airspace over the house, starting from surface to 1200 ft. No communication requirement exists in that airspace. I was never below 500 ft AGL any time, except when I came in for a landing or when I took off from the landing zone. I did my approach from 300 ft AGL -- steep approach to the spot. When I took off I did a sort of maximum performance takeoff in front of 2 trees on the landing zone. So I deny the police officer's accusations. I could not have done this flight in any other way. I never flew over the houses at that low altitude, since I flew over a road that exists between the houses below the landing zone. I have filed an incident report to long beach FSDO office and talked with an administrative person.

Title: PLT OF A ROBINSON R22B HELI PENETRATED CLASS C AIRSPACE WITHOUT ATC CONTACT DURING A LCL PHOTO PAX FLTS FROM A RESIDENTIAL HOUSE WITHIN THE CLASS C AIRSPACE. HE WAS OBSERVED BY A LCL LAW ENFORCEMENT OFFICER IN A POLICE HELI WHO HAD BEEN ALERTED BY ATC RADAR CTLR. IN ADDITION, HE LANDED AND TOOK OFF ON A PUBLIC STREET WITHOUT LCL GOV PERMISSION.

I DID 4 X 10 MIN DEMOS FOLLOWING A ROAD THAT LEADS DOWN TO THE BEACH. AFTER MY LAST LNDG, A HUGHES 500 HELI CIRCLES OVER US AND MINS LATER 2 POLICE CARS ARRIVED AT THE LNDG ZONE. THEY CHKED MY LICENSE AND ACCUSED ME OF NOT COMMUNICATING WITH THE POLICE HELI, AND NOT COMMUNICATING WITH EL TORO TWR, AND OF FLYING TOO LOW OVER DANA POINT AND BEING ONLY 50 FT OVER THE HOUSES ON MY APCH TO THE LNDG ZONE ON CUL DE SAC, MOUNTAIN OR HILL. THEY ALSO SAID I HAD VIOLATED THE SPECIAL FLT RULES AREA. BOTH ME AND MY PAX DID NOT HEAR ANYBODY TALKING TO US, EXCEPT ONE PLT BROADCASTING WITH EL TORO TFC, AND ONE PERSON SAYING THAT EL TORO TWR WAS CLOSED. I CALLED EL TORO TWR 5 TIMES BEFORE ENTERING THE AREA IN LAGUNA NIGEL, BUT THE TWR NEVER RESPONDED. THE AIRSPACE IS CLASS G AIRSPACE OVER THE HOUSE, STARTING FROM SURFACE TO 1200 FT. NO COM REQUIREMENT EXISTS IN THAT AIRSPACE. I WAS NEVER BELOW 500 FT AGL ANY TIME, EXCEPT WHEN I CAME IN FOR A LNDG OR WHEN I TOOK OFF FROM THE LNDG ZONE. I COULD NOT HAVE DONE THIS FLT IN ANY OTHER WAY. I NEVER FLEW OVER THE HOUSES AT THAT LOW ALT, SINCE I FLEW OVER A ROAD THAT EXISTS BTWN THE HOUSES BELOW THE LNDG ZONE. I HAVE FILED AN INCIDENT RPT TO LONG BEACH FSDO OFFICE AND TALKED WITH AN ADMINISTRATIVE PERSON.
