Narrative:

Lga tower cleared us for immediate takeoff on runway 31 and advised us of the B727 (air carrier Y) on 2 mi final for runway 22. During climb out 100 ft AGL, I noticed air carrier Y leveling and going around. I leveled at 200 ft AGL and air carrier Y showed level at 200 ft above us on TCASII. Air carrier Y passed right over us. I feel the major contributing factor was ATC giving us clearance to takeoff and taking away air carrier Y's option for a safe go around. Pilots should be able to abort lndgs at any time without a traffic conflict. Lahso clrncs and crossing runway operations contribute to sits like this arising. Eventually a collision is going to result unless ATC and pilots are trained and disciplined to maintain safe distances at airports like lga and dca. The real solution is to create parallel runways for simultaneous takeoffs and lndgs.

Narrative: LGA TWR CLRED US FOR IMMEDIATE TKOF ON RWY 31 AND ADVISED US OF THE B727 (ACR Y) ON 2 MI FINAL FOR RWY 22. DURING CLBOUT 100 FT AGL, I NOTICED ACR Y LEVELING AND GOING AROUND. I LEVELED AT 200 FT AGL AND ACR Y SHOWED LEVEL AT 200 FT ABOVE US ON TCASII. ACR Y PASSED RIGHT OVER US. I FEEL THE MAJOR CONTRIBUTING FACTOR WAS ATC GIVING US CLRNC TO TKOF AND TAKING AWAY ACR Y'S OPTION FOR A SAFE GAR. PLTS SHOULD BE ABLE TO ABORT LNDGS AT ANY TIME WITHOUT A TFC CONFLICT. LAHSO CLRNCS AND XING RWY OPS CONTRIBUTE TO SITS LIKE THIS ARISING. EVENTUALLY A COLLISION IS GOING TO RESULT UNLESS ATC AND PLTS ARE TRAINED AND DISCIPLINED TO MAINTAIN SAFE DISTANCES AT ARPTS LIKE LGA AND DCA. THE REAL SOLUTION IS TO CREATE PARALLEL RWYS FOR SIMULTANEOUS TKOFS AND LNDGS.
