Narrative:

On preflight, notified by maintenance of MEL item of #1 VOR needle off by 10 degrees. Referenced company MEL/cdl with mechanic and deferred this #1 VOR RMI needle. Supplemental information from acn 341552: days later, I was informed that we were not legal to fly that aircraft. In defense of the captain and crew the deferment was given to the captain 10-15 mins prior to blockout (a very busy time for everyone) and I suspect that the captain took for granted that if maintenance is deferring this it must be ok. Also I suspect that maintenance showed the captain the wrong page/item in the MEL and or the captain misread it.

Title: MAINT DEFERRED A NONDEFERRABLE ITEM, VOR NEEDLE OFF BY 10 DEGS. FLC ASSUMED THAT MAINT KNEW WHAT WAS CORRECT, BUT LATER FOUND OUT THAT IT WAS ILLEGAL TO DEFER THE ITEM.

IN DEFENSE OF THE CAPT AND CREW THE DEFERMENT WAS GIVEN TO THE CAPT 10-15 MINS PRIOR TO BLOCKOUT (A VERY BUSY TIME FOR EVERYONE) AND I SUSPECT THAT THE CAPT TOOK FOR GRANTED THAT IF MAINT IS DEFERRING THIS IT MUST BE OK. ALSO I SUSPECT THAT MAINT SHOWED THE CAPT THE WRONG PAGE/ITEM IN THE MEL AND OR THE CAPT MISREAD IT.
