Narrative:

At approximately 60 NM north of the vagan intersection traveling sbound on UA315, under miq control, I received a TCASII TA followed immediately by an RA to make a right climbing turn. Began the evasive maneuver and saw an air carrier B767 proceeding northbound towards us. I completed the evasive maneuver and returned to our clearance altitude of 37000 ft. Based upon my conversation with the other crew, it appears that miq control had cleared other aircraft to climb from 35000 ft to 39000 ft. I estimate that we came within 2-3 mi and 800 ft. Callback conversation with reporter revealed the following information: the reporter states that the airspace in the svzm area is 'like a freeway. Everybody congregates there at the same time, both directions. Both the reporter and the oncoming aircraft took evasive action and both aircraft called svzm to ask about the other traffic. They got the usual response, svzm clammed up and wouldn't talk to them. The reporter and the other aircraft talked to each other on the 'common frequency' after the incident. The reporter heard the other aircraft receive a clearance to climb, so was somewhat prepared for another aircraft in the vicinity. This was in daylight VMC. The reporter has not experienced this situation before in this area, but he has heard many similar stories from other crew persons.

Title: SVZM ARTCC CLBED ANOTHER ACFT THROUGH THE RPTR'S ALT.

BEGAN THE EVASIVE MANEUVER AND SAW AN ACR B767 PROCEEDING NBOUND TOWARDS US. I COMPLETED THE EVASIVE MANEUVER AND RETURNED TO OUR CLRNC ALT OF 37000 FT. BASED UPON MY CONVERSATION WITH THE OTHER CREW, IT APPEARS THAT MIQ CTL HAD CLRED OTHER ACFT TO CLB FROM 35000 FT TO 39000 FT. I ESTIMATE THAT WE CAME WITHIN 2-3 MI AND 800 FT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THE RPTR STATES THAT THE AIRSPACE IN THE SVZM AREA IS 'LIKE A FREEWAY. EVERYBODY CONGREGATES THERE AT THE SAME TIME, BOTH DIRECTIONS. BOTH THE RPTR AND THE ONCOMING ACFT TOOK EVASIVE ACTION AND BOTH ACFT CALLED SVZM TO ASK ABOUT THE OTHER TFC. THEY GOT THE USUAL RESPONSE, SVZM CLAMMED UP AND WOULDN'T TALK TO THEM. THE RPTR AND THE OTHER ACFT TALKED TO EACH OTHER ON THE 'COMMON FREQ' AFTER THE INCIDENT. THE RPTR HEARD THE OTHER ACFT RECEIVE A CLRNC TO CLB, SO WAS SOMEWHAT PREPARED FOR ANOTHER ACFT IN THE VICINITY. THIS WAS IN DAYLIGHT VMC. THE RPTR HAS NOT EXPERIENCED THIS SIT BEFORE IN THIS AREA, BUT HE HAS HEARD MANY SIMILAR STORIES FROM OTHER CREW PERSONS.
