Narrative:

Missed crossing clearance of 40 NM out by 8000 ft due to lack of communication between myself and first officer. Supplemental information from acn 327729: given restr to cross 40 NM north of bpt at 8000 ft. Transmission received and acknowledged by first officer, which was on headset. Believing the captain (the PF) had received and understood restr, 8000 ft was set in preselector. As it turned out, captain was off headset with speaker volume turned down, and never understood the crossing restr, but instead descended at his discretion to 8000 ft! 45 NM from bpt first officer noticed the altitude was still 15200 ft, and asked captain if he would be able to make 40 at 8000 ft. Center was notified of the inability to meet restr, and descent continued without further problems. In retrospect we should always make sure that all xmissions are received and understood by all crew members.
