Narrative:

While at cruise at FL280, center gave us a TA of a T38 12 O'clock at FL270. The captain down-ranged the TCASII from 40 mi to 10 mi and noticed that the traffic was beginning a climb. He said 'this guy's climbing' or something to that effect. Just after, the TCASII gave us an RA to 'climb, climb!' I climbed to 28500 ft MSL until the TCASII reported 'clear of conflict.' the captain notified ATC of the situation and the center controller stated that he had seen no conflict on his scope. The captain replied that our TCASII had advised us to take evasive action and as per company policy, we absolutely followed suit. Supplemental information from acn 328367: I last noticed the TCASII traffic symbol at FL276 before looking outside trying to acquire the target. We climbed through FL288 before receiving a TCASII 'clear of conflict.' I was not sure how close the traffic had come as I never did see it, until flight attendant in first class section reported seeing a 'fighter' out the window while she was standing in the aisle or middle of the aircraft. She stated that the traffic was 'close' and only slightly low, and this was at the time that we had stopped our evasive maneuver -- FL287. A passenger in first class cabin also reported sighting the traffic.

Title: DURING CRUISE, AN ACR FLC TOOK EVASIVE ACTION WHEN THEY RECEIVED AN RA TO CLB AWAY FROM A T38 BELOW. A FLT ATTENDANT AND PAX SAW THE T38 FROM THE FIRST CLASS CABIN WINDOW AFTER THE FLC HAD STOPPED THE EVASIVE MANEUVER. ALTDEV ALT EXCURSION (T38).

Narrative: WHILE AT CRUISE AT FL280, CTR GAVE US A TA OF A T38 12 O'CLOCK AT FL270. THE CAPT DOWN-RANGED THE TCASII FROM 40 MI TO 10 MI AND NOTICED THAT THE TFC WAS BEGINNING A CLB. HE SAID 'THIS GUY'S CLBING' OR SOMETHING TO THAT EFFECT. JUST AFTER, THE TCASII GAVE US AN RA TO 'CLB, CLB!' I CLBED TO 28500 FT MSL UNTIL THE TCASII RPTED 'CLR OF CONFLICT.' THE CAPT NOTIFIED ATC OF THE SIT AND THE CTR CTLR STATED THAT HE HAD SEEN NO CONFLICT ON HIS SCOPE. THE CAPT REPLIED THAT OUR TCASII HAD ADVISED US TO TAKE EVASIVE ACTION AND AS PER COMPANY POLICY, WE ABSOLUTELY FOLLOWED SUIT.
