Narrative:

Flight from sjc to ord, we were departing sjc on the loupe 9 SID. As we were leveling off at 5000 ft, departure cleared us to cross sjc VOR at or above 12000 ft and climb to FL230. At approximately 3 DME before crossing sjc, at approximately 13500 ft, the next controller asked if we were cleared to cross sjc at 12000 ft or at or above 12000 ft. With all the distractions of flying this SID the captain and I both believe that we complied with the clearance as given by departure. I do not believe that there was any conflict as the TCASII screen was blank.

Title: AN ACR MD80 FLC FAILED TO ADHERE TO THE PUBLISHED SID XING RESTR. BOTH CREW MEMBERS THOUGHT THAT THEY WERE CLRED BY ATC TO CROSS AT OR ABOVE 12000 FT. THE NEW CTLR QUERIED WHEN THE FLC WAS CLBING THROUGH 13500 FT.

WITH ALL THE DISTRACTIONS OF FLYING THIS SID THE CAPT AND I BOTH BELIEVE THAT WE COMPLIED WITH THE CLRNC AS GIVEN BY DEP. I DO NOT BELIEVE THAT THERE WAS ANY CONFLICT AS THE TCASII SCREEN WAS BLANK.
