Narrative:

On the mip 8 arrival to lga we were never given clearance to cross marrc at FL180. Cruising at FL280 we were handed over to frequency 133.5. The controller was surprised that we hadn't been given the crossing restr at marrc and told us to cross 'vibes' at 13000 ft. Using maximum descent rate, we were still 1000 ft high at 'vibes.' we were unable to advise the controller of the impending situation due to radio frequency congestion. The controller then accused us of 'missing 2 crossing altitudes over the last 2 frequencys.' we reiterated that we had never been given lower than FL280 before switching to his frequency.

Title: MISCOM ATC FLC ON XING RESTRS. AFTER CHANGING FREQS, CTLR WAS SURPRISED THAT FLC HAD NOT BEEN PREVIOUSLY CLRED FOR XING, BUT ISSUED NEW CLRNC TO CROSS NEXT FIX AT XING RESTR. FLC DSNDED AT MAX RATE, BUT UNABLE TO MAKE RESTR AND, DUE TO FREQ CONGESTION, WAS UNABLE TO NOTIFY ATC OF THAT FACT.

THE CTLR WAS SURPRISED THAT WE HADN'T BEEN GIVEN THE XING RESTR AT MARRC AND TOLD US TO CROSS 'VIBES' AT 13000 FT. USING MAX DSCNT RATE, WE WERE STILL 1000 FT HIGH AT 'VIBES.' WE WERE UNABLE TO ADVISE THE CTLR OF THE IMPENDING SIT DUE TO RADIO FREQ CONGESTION. THE CTLR THEN ACCUSED US OF 'MISSING 2 XING ALTS OVER THE LAST 2 FREQS.' WE REITERATED THAT WE HAD NEVER BEEN GIVEN LOWER THAN FL280 BEFORE SWITCHING TO HIS FREQ.
