Narrative:

ZID cleared flight to descend and cross the 40 DME of cvg VOR 12000 ft 250 KTS. It was going to be close since we were started down late. I requested that the 250 KT restr be lifted thinking that I would be able to make the 12000 ft. I misjudged my ability to make the restr even at a high rate of descent. Over-flew point by approximately 3 mi. My error was not in advising center that we would be unable to make it. Should have declared inability to controller. No traffic conflict reported.

Narrative: ZID CLRED FLT TO DSND AND CROSS THE 40 DME OF CVG VOR 12000 FT 250 KTS. IT WAS GOING TO BE CLOSE SINCE WE WERE STARTED DOWN LATE.
