Narrative:

We were en route from syr (syracuse, ny) to phl (philadelphia, PA), at 12000 ft awaiting climb clearance to cruise altitude. ZNY (133.35) issued traffic at 13000 ft at our 2 O'clock position and 10 mi. At about 5 mi we saw the traffic, a twin cessna. We reported the traffic in sight and were issued clearance to a higher altitude. We maintained visual contact with the traffic and began a climb. As we did so we got a traffic alert and then a RA on TCASII. I watched the traffic pass behind us at the 4 O'clock position and about 3 mi. We continued the climb and did not respond to the RA. In my opinion there was not a conflict, though the standard IFR separation did not exist. Again, we maintained visual separation while climbing with reference to the other aircraft.

Title: PUB AVAILABILITY -- ACR CREW RPTS THAT THEY MADE A CLB AS CLRED BY THE ARTCC RADAR CTLR USING THEIR VISUAL SEPARATION.

Narrative: WE WERE ENRTE FROM SYR (SYRACUSE, NY) TO PHL (PHILADELPHIA, PA), AT 12000 FT AWAITING CLB CLRNC TO CRUISE ALT. ZNY (133.35) ISSUED TFC AT 13000 FT AT OUR 2 O'CLOCK POS AND 10 MI. AT ABOUT 5 MI WE SAW THE TFC, A TWIN CESSNA. WE RPTED THE TFC IN SIGHT AND WERE ISSUED CLRNC TO A HIGHER ALT. WE MAINTAINED VISUAL CONTACT WITH THE TFC AND BEGAN A CLB. AS WE DID SO WE GOT A TFC ALERT AND THEN A RA ON TCASII. I WATCHED THE TFC PASS BEHIND US AT THE 4 O'CLOCK POS AND ABOUT 3 MI. WE CONTINUED THE CLB AND DID NOT RESPOND TO THE RA. IN MY OPINION THERE WAS NOT A CONFLICT, THOUGH THE STANDARD IFR SEPARATION DID NOT EXIST. AGAIN, WE MAINTAINED VISUAL SEPARATION WHILE CLBING WITH REF TO THE OTHER ACFT.
