Narrative:

WX scattered to broken with runway in area. Cleared to takeoff runway 19 with canales 2 departure moyuta transition. The departure requires that you intercept the aur 169 degree radial after takeoff to canales or 9000 ft, whichever occurs first, then turn to an 080 degree heading to intercept the 169 degree radial on course. Tower cleared us for takeoff, we asked for the noise abatement climb (company procedure) but the tower did not respond. As soon as airborne we contacted departure and asked for runway heading to 4 DME. Controller cleared us to FL410 and told us to intercept the 140 degree radial of aur to 20 DME, then on course. I started the left turn planning not to go east of the 169 degree radial until 9000 ft for terrain clearance per the departure. During the turn TCASII picked up traffic at 1 O'clock approximately 10 mi. I tightened up the turn but still got RA advisory which we complied with. Controller complained that we did not get on the 140 degree radial. However, we could not get to the 140 degree radial quickly enough to avoid a conflict because: 1) the departure specifies that we stay on the 169 degree radial until reaching 9000 ft. 2) the procedure requiring us to request runway heading till 4 DME puts us further south at a high rate of speed even when the request is denied because of the time delay. I strongly believe that company should drop this noise abatement procedure. TCASII saved the day. As a crew I do not see any way we could have avoided the conflict. ATC should have used altitude to separate us from the traffic.

I STRONGLY BELIEVE THAT COMPANY SHOULD DROP THIS NOISE ABATEMENT PROC. TCASII SAVED THE DAY. AS A CREW I DO NOT SEE ANY WAY WE COULD HAVE AVOIDED THE CONFLICT. ATC SHOULD HAVE USED ALT TO SEPARATE US FROM THE TFC.
