Narrative:

IMC climbing to 10000 ft through given 11000 ft. We were in the tops, moderate turbulence. We were given a vector, so we were climbing at 2500 FPM and broke into the clear. Looking ahead I could see in about 60 seconds would reenter IMC and a moderate turbulence ride. I quickly asked first officer for an on top clearance and continued climb to stay well clear and smooth ride. He asked for it and she came back with 'roger on top at 17500,' which was kind of unclr. Moments later she asked our altitude. I said '12000 climbing on top,' she said to maintain VFR on top at 12500 ft and that she hadn't cleared us prior to that. Traffic not a factor just she was busy.

I SAID '12000 CLBING ON TOP,' SHE SAID TO MAINTAIN VFR ON TOP AT 12500 FT AND THAT SHE HADN'T CLRED US PRIOR TO THAT. TFC NOT A FACTOR JUST SHE WAS BUSY.
