Narrative:

On jan/xx/95 I unintentionally exceeded far 135.265, exceeding 34 scheduled flight hours in a 7 day period, by 1.6 flight hours. On the evening of jan/xy/95 I completed my scheduled forecast for jan/xx/95. I was scheduled for 4.4 hours which put my 7 day total forecast at 33.5 hours. I accepted the trip and flew 4.4 hours on the morning of jan/xx/95. After completing my trip and arriving in medford, I totaled out my flight crew member rest plus flight time record which reflected 33.5 hours in the past 7 days and filed it in my locker with my flight gear. I then pursued commuting back to sjc on our next flight out of medford to spend 2 days off. I completed a jumpseat form and presented it to the captain of the afternoon crew. At that time the captain stated to me that the first officer had called in sick and he was calling operations to see if the flight would be canceled. Since the captain had received my jumpseat form and knew I was trying to commute to sjc, he asked if I would be willing to fly the trip to sjc as a first officer, and then he would pick up a reserve first officer in sjc for the rest of the day. Because I had completed my shift for the day and already totaled out my log, and because I was going to fly the trip to sjc as a first officer and not as a captain, I did not realize that I would be exceeding 34 scheduled flight hours. I mistakenly thought of this trip as being an unscheduled for me as a first officer as opposed to a scheduled leg as a captain. I flew the scheduled 2.1 hour trip to sjc in 2.2 hours and then took 2 days off. I was not until doing my forecast on jan/aa/95 for my trip on jan/xx/95 that I realized I may have been in violation by accepting that last trip as a first officer on jan/xx/95. I discussed the issue with the chief pilot and he informed me that I was in violation. I had no intention of flying more than my scheduled 4.4 hours on jan/xx/95. When I accepted the trip as first officer I was trying to help out the company and the medford crew. In hurrying to get my flight gear back in the plane and to get out on time, I neglected to consider my 7 day total time as a factor. I've learned a valuable lesson, and I am certain I will not exceed a flight time limit again.

Title: NON ADHERENCE TO FAR 135 PT 265 FLT TIME LIMITATIONS BY EXCEEDING 34 HRS COMMERCIAL FLT TIME IN 7 DAYS.

Narrative: ON JAN/XX/95 I UNINTENTIONALLY EXCEEDED FAR 135.265, EXCEEDING 34 SCHEDULED FLT HRS IN A 7 DAY PERIOD, BY 1.6 FLT HRS. ON THE EVENING OF JAN/XY/95 I COMPLETED MY SCHEDULED FORECAST FOR JAN/XX/95. I WAS SCHEDULED FOR 4.4 HRS WHICH PUT MY 7 DAY TOTAL FORECAST AT 33.5 HRS. I ACCEPTED THE TRIP AND FLEW 4.4 HRS ON THE MORNING OF JAN/XX/95. AFTER COMPLETING MY TRIP AND ARRIVING IN MEDFORD, I TOTALED OUT MY FLC MEMBER REST PLUS FLT TIME RECORD WHICH REFLECTED 33.5 HRS IN THE PAST 7 DAYS AND FILED IT IN MY LOCKER WITH MY FLT GEAR. I THEN PURSUED COMMUTING BACK TO SJC ON OUR NEXT FLT OUT OF MEDFORD TO SPEND 2 DAYS OFF. I COMPLETED A JUMPSEAT FORM AND PRESENTED IT TO THE CAPT OF THE AFTERNOON CREW. AT THAT TIME THE CAPT STATED TO ME THAT THE FO HAD CALLED IN SICK AND HE WAS CALLING OPS TO SEE IF THE FLT WOULD BE CANCELED. SINCE THE CAPT HAD RECEIVED MY JUMPSEAT FORM AND KNEW I WAS TRYING TO COMMUTE TO SJC, HE ASKED IF I WOULD BE WILLING TO FLY THE TRIP TO SJC AS A FO, AND THEN HE WOULD PICK UP A RESERVE FO IN SJC FOR THE REST OF THE DAY. BECAUSE I HAD COMPLETED MY SHIFT FOR THE DAY AND ALREADY TOTALED OUT MY LOG, AND BECAUSE I WAS GOING TO FLY THE TRIP TO SJC AS A FO AND NOT AS A CAPT, I DID NOT REALIZE THAT I WOULD BE EXCEEDING 34 SCHEDULED FLT HRS. I MISTAKENLY THOUGHT OF THIS TRIP AS BEING AN UNSCHEDULED FOR ME AS A FO AS OPPOSED TO A SCHEDULED LEG AS A CAPT. I FLEW THE SCHEDULED 2.1 HR TRIP TO SJC IN 2.2 HRS AND THEN TOOK 2 DAYS OFF. I WAS NOT UNTIL DOING MY FORECAST ON JAN/AA/95 FOR MY TRIP ON JAN/XX/95 THAT I REALIZED I MAY HAVE BEEN IN VIOLATION BY ACCEPTING THAT LAST TRIP AS A FO ON JAN/XX/95. I DISCUSSED THE ISSUE WITH THE CHIEF PLT AND HE INFORMED ME THAT I WAS IN VIOLATION. I HAD NO INTENTION OF FLYING MORE THAN MY SCHEDULED 4.4 HRS ON JAN/XX/95. WHEN I ACCEPTED THE TRIP AS FO I WAS TRYING TO HELP OUT THE COMPANY AND THE MEDFORD CREW. IN HURRYING TO GET MY FLT GEAR BACK IN THE PLANE AND TO GET OUT ON TIME, I NEGLECTED TO CONSIDER MY 7 DAY TOTAL TIME AS A FACTOR. I'VE LEARNED A VALUABLE LESSON, AND I AM CERTAIN I WILL NOT EXCEED A FLT TIME LIMIT AGAIN.
