Narrative:

This was a corporate flight from thomasville, GA (tvi) to fayetteville, ar (fyv). The departure was on oct/mon/94, at approximately XA10 EST. The flight was planned for 1 plus 50 hours at a cruising altitude of FL350. The WX on departure at fyv was E100 broken 12, temperature 59 degrees, dewpoint 49 degrees, winds and visibility 190 at 13. The forecast was C20 overcast 310 at 12, occn C12 overcast 4 rw-. Due to the number of passenger we were only able to top the wings which gave us approximately 3300 pounds fuel. The flight proceeded uneventfully and about 125 mi from fyv we received the ATIS XA52Z WX 12 scattered 60 overcast 10 rw- 56 degrees/54 degrees, 210 at 12 overcast 20 altimeter 29.84 visual approach runway 16. After being cleared to 5000 ft and turned over to fyz approach, we were cleared to the elmie intersection which is the IAF on the localizer 16 approach at fyz. At approximately XB50 EST we were told to hold at the elmie intersection with an efc time of XC15 EST. At this time we had approximately 1100 pounds of fuel. The controller told us we were #1 to land at fyz, but he could not clear us until another aircraft completed an approach at rogers. (This being a non radar environment.) after holding for about 15 mins at that altitude our fuel situation was becoming a concern. At that time with the WX information I had there was no doubt that I couldn't land at fyv. We passed our fuel situation on to the fyz controller who said he would do the best he could for us. However, a few mins later our efc time was changed to XC20 EST. We advised the controller that with our fuel state we couldn't take anymore delays. The controller said the aircraft on approach into rogers had missed and he could not clear us for approach until he reached the razorback VOR and turned east. At about that time we received current ATIS sp WX E8 overcast 10 rw- 300 at 22 localizer runway 22 approach. At XC25 the fyz controller cleared us for the localizer 16 approach. We immediately started the approach. We broke out of the clouds at approximately 800 ft AGL, but due to the strong tailwind we were too high and fast to land straight in. We attempted a circling approach, but due to lower ceiling and visibility to the south we were unable. We were cleared back to the fyz controller who cleared us to the summo intersection. We were now down to approximately 500 pounds of fuel. We told the pyz controller we were unable to comply and at that point declared an emergency due to our fuel state. The fyz controller asked if we could make it to fsm. I said yes, at which time we proceeded to fsm where we landed with approximately 200 pounds fuel.

WE ADVISED THE CTLR THAT WITH OUR FUEL STATE WE COULDN'T TAKE ANYMORE DELAYS. THE CTLR SAID THE ACFT ON APCH INTO ROGERS HAD MISSED AND HE COULD NOT CLR US FOR APCH UNTIL HE REACHED THE RAZORBACK VOR AND TURNED E. AT ABOUT THAT TIME WE RECEIVED CURRENT ATIS SP WX E8 OVCST 10 RW- 300 AT 22 LOC RWY 22 APCH. AT XC25 THE FYZ CTLR CLRED US FOR THE LOC 16 APCH. WE IMMEDIATELY STARTED THE APCH.
