Narrative:

2 aircraft involved were on MD80 jet and a new DA90 jet. The pilot of the DA90 called on the telephone to coordination a time speed run from a GA airport just south of ontario airport. He was to take off and fly south of the GA airport -- turn no at 3000 ft MSL accelerate to 250 KTS and cross over the GA airport at 3000 ft to get a time for certification, climb VFR to 17500 and get an IFR clearance from center. The MD80 was released for departure after the DA90 was airborne. The departure path of the MD80 overflew the GA airport. The DA90 turned to overfly the GA airport level at 3000 ft MSL -- the MD80 was in a turn to overfly the GA airport and was observed above 3000 ft MSL. The DA90 continued to climb while south of the GA airport in conflict with the MD80. The DA90 did not acknowledge altitude instructions, the MD80 leveled off in response to a 2TA/RA. Traffic was passed to both aircraft, acknowledged but not in sight by either aircraft. The aircraft passed within 500 vt vertical and approximately 1/2 NM. 1 aircraft VFR the other IFR. Supplemental information from acn 287135: after departure from ont we had a near-miss with falcon jet. We were climbing to 7000 ft and had to level off at 3300 due to TCASII RA, stop climb. ATC had just advised to expedite climb. The falcon jet was a VFR departure from chino with a clearance to climb VFR to 3000 ft. Falcon jet passed overhead 300-400 ft. Other than a power reduction to level off --no abrupt evasive maneuver was required.

THE DA90 CONTINUED TO CLB WHILE S OF THE GA ARPT IN CONFLICT WITH THE MD80. THE DA90 DID NOT ACKNOWLEDGE ALT INSTRUCTIONS, THE MD80 LEVELED OFF IN RESPONSE TO A 2TA/RA. TFC WAS PASSED TO BOTH ACFT, ACKNOWLEDGED BUT NOT IN SIGHT BY EITHER ACFT. THE ACFT PASSED WITHIN 500 VT VERT AND APPROX 1/2 NM. 1 ACFT VFR THE OTHER IFR.
