Narrative:

Air carrier X was converging with aircraft at FL310. I planned to descend air carrier X to FL280. Air carrier X then requested FL350 and ride reports at FL280 and FL350. After coordination with diw high sector I issued clearance to FL350. Later I instructed air carrier X to remain at FL310 which his mode C indicated he was still at. After issuing this 3 times and no response from the pilot, I turned air carrier Y that was leveled at FL330.

Title: ACR X CLBED THROUGH OCCUPIED ALT HAD LTSS FROM ACR Y. SYS ERROR.

Narrative: ACR X WAS CONVERGING WITH ACFT AT FL310. I PLANNED TO DSND ACR X TO FL280. ACR X THEN REQUESTED FL350 AND RIDE RPTS AT FL280 AND FL350. AFTER COORD WITH DIW HIGH SECTOR I ISSUED CLRNC TO FL350. LATER I INSTRUCTED ACR X TO REMAIN AT FL310 WHICH HIS MODE C INDICATED HE WAS STILL AT. AFTER ISSUING THIS 3 TIMES AND NO RESPONSE FROM THE PLT, I TURNED ACR Y THAT WAS LEVELED AT FL330.
