Narrative:

Cleared to FL280 by santo domingo control. While in the climb our altitude was amended to maintain FL260. While cruising at FL260 for approximately 5 mins, we picked up an aircraft at our 1 O'clock position approximately 20 NM and 2000 ft above inbound to pta fix. Aircraft was in a descent. We made visual contact about 13-15 NM. Aircraft continued descent to about 500 ft above our altitude, then began a climb. Closest point was 500 ft above and 5 NM northeast. Aircraft was transitioning from previous airway to new airway east of our position. Although we had a TCASII RA we had visual contact and no deviation was necessary. Both aircraft had TCASII warnings. Both aircraft queried santo domingo control about mutual traffic. Other aircraft was cleared by santo domingo to descend.

Narrative: CLRED TO FL280 BY SANTO DOMINGO CTL. WHILE IN THE CLB OUR ALT WAS AMENDED TO MAINTAIN FL260. WHILE CRUISING AT FL260 FOR APPROX 5 MINS, WE PICKED UP AN ACFT AT OUR 1 O'CLOCK POS APPROX 20 NM AND 2000 FT ABOVE INBOUND TO PTA FIX. ACFT WAS IN A DSCNT. WE MADE VISUAL CONTACT ABOUT 13-15 NM. ACFT CONTINUED DSCNT TO ABOUT 500 FT ABOVE OUR ALT, THEN BEGAN A CLB. CLOSEST POINT WAS 500 FT ABOVE AND 5 NM NE. ACFT WAS TRANSITIONING FROM PREVIOUS AIRWAY TO NEW AIRWAY E OF OUR POS. ALTHOUGH WE HAD A TCASII RA WE HAD VISUAL CONTACT AND NO DEV WAS NECESSARY. BOTH ACFT HAD TCASII WARNINGS. BOTH ACFT QUERIED SANTO DOMINGO CTL ABOUT MUTUAL TFC. OTHER ACFT WAS CLRED BY SANTO DOMINGO TO DSND.
