Narrative:

During climb out at phl, as we were climbing out, we were given a turn to the northwest. In the turn we saw traffic at 8500 ft and confirmed on TCASII. We were climbing to 10000 ft and our courses and altitudes were on an intercepting course. Climbing at approximately 3000 FPM we questioned ATC of traffic and he told us to level at 8000 ft. At this time RA said descend. We confirmed 8000 ft level off and after clear of conflict, began a climb and at 8500 ft I told captain (PF) we had been cleared to 8000 ft only due to conflicting traffic. The above happened within a span of 10-15 seconds. We reconfirmed altitude to ATC at 8000 ft and were then cleared to 10000 ft.

Narrative: DURING CLBOUT AT PHL, AS WE WERE CLBING OUT, WE WERE GIVEN A TURN TO THE NW. IN THE TURN WE SAW TFC AT 8500 FT AND CONFIRMED ON TCASII. WE WERE CLBING TO 10000 FT AND OUR COURSES AND ALTS WERE ON AN INTERCEPTING COURSE. CLBING AT APPROX 3000 FPM WE QUESTIONED ATC OF TFC AND HE TOLD US TO LEVEL AT 8000 FT. AT THIS TIME RA SAID DSND. WE CONFIRMED 8000 FT LEVEL OFF AND AFTER CLR OF CONFLICT, BEGAN A CLB AND AT 8500 FT I TOLD CAPT (PF) WE HAD BEEN CLRED TO 8000 FT ONLY DUE TO CONFLICTING TFC. THE ABOVE HAPPENED WITHIN A SPAN OF 10-15 SECONDS. WE RECONFIRMED ALT TO ATC AT 8000 FT AND WERE THEN CLRED TO 10000 FT.
