Narrative:

We were given 35-40 min departure delay at dfw-den (XA54Z departure). We took off at XA51Z -- 3 mins before delay time, then were put behind another flight on same route (dfw-den), but he was scheduled to leave dfw 10 mins after us, so he had to have departed approximately 15 mins before his ATC departure time -- evidently a deliberate violation of ATC procedures. Arriving in den, evidently only our flight, the one ahead of us, and one from aus-den had been delayed. All the other flts in the den traffic pattern were approximately on time, evidence that ATC was discriminating with ATC hold procedures.

Title: RPTR COMPLAINS THEIR DEP TIME WAS LATER THAN SOME OTHERS THEREBY DISCRIMINATING AGAINST THEM.

Narrative: WE WERE GIVEN 35-40 MIN DEP DELAY AT DFW-DEN (XA54Z DEP). WE TOOK OFF AT XA51Z -- 3 MINS BEFORE DELAY TIME, THEN WERE PUT BEHIND ANOTHER FLT ON SAME RTE (DFW-DEN), BUT HE WAS SCHEDULED TO LEAVE DFW 10 MINS AFTER US, SO HE HAD TO HAVE DEPARTED APPROX 15 MINS BEFORE HIS ATC DEP TIME -- EVIDENTLY A DELIBERATE VIOLATION OF ATC PROCS. ARRIVING IN DEN, EVIDENTLY ONLY OUR FLT, THE ONE AHEAD OF US, AND ONE FROM AUS-DEN HAD BEEN DELAYED. ALL THE OTHER FLTS IN THE DEN TFC PATTERN WERE APPROX ON TIME, EVIDENCE THAT ATC WAS DISCRIMINATING WITH ATC HOLD PROCS.
