Narrative:

While on the ILS-4 approach to lga, we received a TCASII TA at 6 mi out. Following the RA instructions resulted in us being slightly above the GS for several seconds. After the 'clear of conflict' message was received, the GS was recaptured and the approach resumed. RA came from a VFR helicopter down low below the overcast operating through the approach course. Supplemental information from acn 252808: ATC should not clear aircraft to fly beneath approach course when ILS in use.

Title: TCASII RA INSTIGATES EVASIVE ACTION CLB IN FLC RESPONSE TO PROX OF ROTARY WINGED TFC ON IAP ILS APCH.

Narrative: WHILE ON THE ILS-4 APCH TO LGA, WE RECEIVED A TCASII TA AT 6 MI OUT. FOLLOWING THE RA INSTRUCTIONS RESULTED IN US BEING SLIGHTLY ABOVE THE GS FOR SEVERAL SECONDS. AFTER THE 'CLR OF CONFLICT' MESSAGE WAS RECEIVED, THE GS WAS RECAPTURED AND THE APCH RESUMED. RA CAME FROM A VFR HELI DOWN LOW BELOW THE OVCST OPERATING THROUGH THE APCH COURSE. SUPPLEMENTAL INFORMATION FROM ACN 252808: ATC SHOULD NOT CLR ACFT TO FLY BENEATH APCH COURSE WHEN ILS IN USE.
