Narrative:

Air carrier X sebound climbing to FL190. Air carrier Y swbound descending to FL200 crossing paths. Air carrier X advised responding to a TCASII RA to climb. This resolution caused an near midair collision between 2 acrs. Air carrier Y, although TCASII equipped, did not respond to RA. Pilot (air carrier Y) cited air carrier X in sight as reason for not responding to descent RA. In the 12 seconds that this event occurred, air carrier X climbed 2000 ft. TCASII has taken a controled situation and turned it into a near midair collision making positive control airspace a thing of the past since no one now has control and each aircraft is free to decide its own path.

Narrative: ACR X SEBOUND CLBING TO FL190. ACR Y SWBOUND DSNDING TO FL200 XING PATHS. ACR X ADVISED RESPONDING TO A TCASII RA TO CLB. THIS RESOLUTION CAUSED AN NMAC BTWN 2 ACRS. ACR Y, ALTHOUGH TCASII EQUIPPED, DID NOT RESPOND TO RA. PLT (ACR Y) CITED ACR X IN SIGHT AS REASON FOR NOT RESPONDING TO DSCNT RA. IN THE 12 SECONDS THAT THIS EVENT OCCURRED, ACR X CLBED 2000 FT. TCASII HAS TAKEN A CTLED SIT AND TURNED IT INTO A NMAC MAKING POSITIVE CTL AIRSPACE A THING OF THE PAST SINCE NO ONE NOW HAS CTL AND EACH ACFT IS FREE TO DECIDE ITS OWN PATH.
