Narrative:

In sum: at time of incident, reporter was not licensed to fly part 135 charters although he had completed most of the work required to do so. A party of men were stranded in yng by a mechanical problem with their aircraft. They called him and almost pleaded with him to fly them to frg. He knew he could not do so under part 135 but he reasoned that if he only charged them for his cost for the flight from yng to frg and the ferry flight back. He charged them 42.50 per hour for 3.45 hours, 862.50 and rounded it off to 865.00 which was less than his actual cost. The reporter was licensed and legal to fly part 91. This is what he did only asking his passenger to reimburse their share of his expenses. He says that he failed to specifically tell the passenger, all presumably pilots, that this was a part 91 operation. He fears that they may assume he was flying an illegal part 135 operation.

Title: PAX WERE FLOWN ON A PART 91 FLT AND CHARGED THEIR SHARE OF EXPENSES. RPTR FEARS THEY MAY THINK IT WAS A PART 135 CHARTER.

Narrative: IN SUM: AT TIME OF INCIDENT, RPTR WAS NOT LICENSED TO FLY PART 135 CHARTERS ALTHOUGH HE HAD COMPLETED MOST OF THE WORK REQUIRED TO DO SO. A PARTY OF MEN WERE STRANDED IN YNG BY A MECHANICAL PROB WITH THEIR ACFT. THEY CALLED HIM AND ALMOST PLEADED WITH HIM TO FLY THEM TO FRG. HE KNEW HE COULD NOT DO SO UNDER PART 135 BUT HE REASONED THAT IF HE ONLY CHARGED THEM FOR HIS COST FOR THE FLT FROM YNG TO FRG AND THE FERRY FLT BACK. HE CHARGED THEM 42.50 PER HR FOR 3.45 HRS, 862.50 AND ROUNDED IT OFF TO 865.00 WHICH WAS LESS THAN HIS ACTUAL COST. THE RPTR WAS LICENSED AND LEGAL TO FLY PART 91.
