Narrative:

I was on a visual approach (NDB 35R) under VFR conditions into cnw. After reporting over robinson beacon inbound, no more instructions were made to me. I was 1/2 mi from the threshold of 35R and was visually looking for traffic. Cnw tower cleared an small aircraft for takeoff on parallel runway 17R. The tower warned the small aircraft of my whereabouts. As I descended down to 980 ft MSL (MDA), I was about to execute missed approach and follow me circle-to-land procedure, which is circle to the east for a landing on 17L. Then the small aircraft requested left turn departure and was cleared for this left turn by tower. The small aircraft was at approximately 1000 ft MSL and started his turn right over the top of my aircraft. I lost visual sight and therefore realized a potential mid-air collision. I looked for incoming traffic on 17L and saw none. My only recourse was to land and get off runway as soon as possible, landing with a 10 KT tailwind. The entire phase of the flight is on tape from start to finish. On the tape: it showed that after my report over rob NDB beacon, tower gave instructions to report circle-to-land to the east. I did not hear these instructions and tower did not confirm that I had. When I first saw the small aircraft starting his turn he was so close I could see the pilots faces. I called the tower immediately after the flight by phone and he claimed we had adequate separation from his point of view. As PIC I determined we did not have adequate separation, therefore meeting the extent of the emergency, chose to do as I have stated. A report was filed by the controller. He stated that, after reviewing the tape, the pilot was given instructions to circle to the east and land 17L and ignored these instructions. An aircraft should not have been cleared into the exact area and at the same altitude that I was supposed to go. When I asked the tower about his instructions that he gave to me, I asked if I complied and read back instructions. His reply was, 'well most the pilots out here never do.'

Title: 2 SMAS HAD AN NMAC IN THE TFC PATTERN UNDER TWR CTL.

Narrative: I WAS ON A VISUAL APCH (NDB 35R) UNDER VFR CONDITIONS INTO CNW. AFTER RPTING OVER ROBINSON BEACON INBOUND, NO MORE INSTRUCTIONS WERE MADE TO ME. AS I DSNDED DOWN TO 980 FT MSL (MDA), I WAS ABOUT TO EXECUTE MISSED APCH AND FOLLOW ME CIRCLE-TO-LAND PROC, WHICH IS CIRCLE TO THE E FOR A LNDG ON 17L. THEN THE SMA REQUESTED L TURN DEP AND WAS CLRED FOR THIS L TURN BY TWR. THE SMA WAS AT APPROX 1000 FT MSL AND STARTED HIS TURN RIGHT OVER THE TOP OF MY ACFT. I LOST VISUAL SIGHT AND THEREFORE REALIZED A POTENTIAL MID-AIR COLLISION. I LOOKED FOR INCOMING TFC ON 17L AND SAW NONE. MY ONLY RECOURSE WAS TO LAND AND GET OFF RWY AS SOON AS POSSIBLE, LNDG WITH A 10 KT TAILWIND. THE ENTIRE PHASE OF THE FLT IS ON TAPE FROM START TO FINISH. ON THE TAPE: IT SHOWED THAT AFTER MY RPT OVER ROB NDB BEACON, TWR GAVE INSTRUCTIONS TO RPT CIRCLE-TO-LAND TO THE E. I DID NOT HEAR THESE INSTRUCTIONS AND TWR DID NOT CONFIRM THAT I HAD. WHEN I FIRST SAW THE SMA STARTING HIS TURN HE WAS SO CLOSE I COULD SEE THE PLTS FACES. I CALLED THE TWR IMMEDIATELY AFTER THE FLT BY PHONE AND HE CLAIMED WE HAD ADEQUATE SEPARATION FROM HIS POINT OF VIEW. AS PIC I DETERMINED WE DID NOT HAVE ADEQUATE SEPARATION, THEREFORE MEETING THE EXTENT OF THE EMER, CHOSE TO DO AS I HAVE STATED. A RPT WAS FILED BY THE CTLR. HE STATED THAT, AFTER REVIEWING THE TAPE, THE PLT WAS GIVEN INSTRUCTIONS TO CIRCLE TO THE E AND LAND 17L AND IGNORED THESE INSTRUCTIONS. AN ACFT SHOULD NOT HAVE BEEN CLRED INTO THE EXACT AREA AND AT THE SAME ALT THAT I WAS SUPPOSED TO GO. WHEN I ASKED THE TWR ABOUT HIS INSTRUCTIONS THAT HE GAVE TO ME, I ASKED IF I COMPLIED AND READ BACK INSTRUCTIONS. HIS REPLY WAS, 'WELL MOST THE PLTS OUT HERE NEVER DO.'
