Narrative:

Cleared to climb to 14000 ft. Going through 13000 ft TCASII announced TA at 11 O'clock and 3 mi. Almost immediately TCASII announced a 'descend' RA. Captain was at flight controls and descended about 500 ft at which time TCASII commanded 'monitor vertical speed' and showed no climb until TCASII announced clear of conflict. During RA commanded descent, both captain and I observed an mdt aircraft at 13500 ft. No evasive action was observed by other aircraft. When ATC was queried when frequency congestion allowed, about 5 mins later, controller insisted repeatedly that his radar had shown no other aircraft than ours in the area and he did not have communications with the mdt. This near midair resulted in a loss of IFR separation, and the captain's appropriate response to the RA resulted in a deviation from our climb clearance.

Title: AN ACR MDT HAS CLOSE PROX WITH ANOTHER ACR MDT. TCASII PROVIDED A WARNING. ATC CLAIMED THAT THERE WAS NO OTHER ACFT IN THE RPTR'S VICINITY.

Narrative: CLRED TO CLB TO 14000 FT. GOING THROUGH 13000 FT TCASII ANNOUNCED TA AT 11 O'CLOCK AND 3 MI. ALMOST IMMEDIATELY TCASII ANNOUNCED A 'DSND' RA. CAPT WAS AT FLT CTLS AND DSNDED ABOUT 500 FT AT WHICH TIME TCASII COMMANDED 'MONITOR VERT SPD' AND SHOWED NO CLB UNTIL TCASII ANNOUNCED CLR OF CONFLICT. DURING RA COMMANDED DSCNT, BOTH CAPT AND I OBSERVED AN MDT ACFT AT 13500 FT. NO EVASIVE ACTION WAS OBSERVED BY OTHER ACFT. WHEN ATC WAS QUERIED WHEN FREQ CONGESTION ALLOWED, ABOUT 5 MINS LATER, CTLR INSISTED REPEATEDLY THAT HIS RADAR HAD SHOWN NO OTHER ACFT THAN OURS IN THE AREA AND HE DID NOT HAVE COMS WITH THE MDT. THIS NEAR MIDAIR RESULTED IN A LOSS OF IFR SEPARATION, AND THE CAPT'S APPROPRIATE RESPONSE TO THE RA RESULTED IN A DEV FROM OUR CLB CLRNC.
