Narrative:

Air carrier X was cleared to FL290. As we were climbing the controller asked another flight his airspeed. The pilot responded and the controller asked him to increase to 310 KTS. The controller then asked air carrier X to maintain 280 or two eight zero but I didn't hear flight level in the call. I set our performance computer for 280 KTS and the captain began to slow the airplane. As we were leveling at FL290 we received a TCASII TA. ATC then called out the traffic and we confirmed traffic in sight. A few moments after the traffic had passed, the controller asked us if we had read back a clearance to maintain FL280. We said no, that we were maintaining 280 KTS. The controller then told us to maintain FL290 and normal speed. Supplemental information from acn 200818. The controller, after assigning FL290 to air carrier X assigned an airspeed of 310 to an air carrier Y, then 280 KTS to air carrier X. Later thought he had assigned FL280 to air carrier X the controller never said 'FL280' until he asked if we acknowledged clearance to 'FL280' and we said no. All parties should use proper ATC phraseology to avoid confusion.

Narrative: ACR X WAS CLRED TO FL290. AS WE WERE CLBING THE CTLR ASKED ANOTHER FLT HIS AIRSPD. THE PLT RESPONDED AND THE CTLR ASKED HIM TO INCREASE TO 310 KTS. THE CTLR THEN ASKED ACR X TO MAINTAIN 280 OR TWO EIGHT ZERO BUT I DIDN'T HEAR FLT LEVEL IN THE CALL. I SET OUR PERFORMANCE COMPUTER FOR 280 KTS AND THE CAPT BEGAN TO SLOW THE AIRPLANE. AS WE WERE LEVELING AT FL290 WE RECEIVED A TCASII TA. ATC THEN CALLED OUT THE TFC AND WE CONFIRMED TFC IN SIGHT. A FEW MOMENTS AFTER THE TFC HAD PASSED, THE CTLR ASKED US IF WE HAD READ BACK A CLRNC TO MAINTAIN FL280. WE SAID NO, THAT WE WERE MAINTAINING 280 KTS. THE CTLR THEN TOLD US TO MAINTAIN FL290 AND NORMAL SPD. SUPPLEMENTAL INFO FROM ACN 200818. THE CTLR, AFTER ASSIGNING FL290 TO ACR X ASSIGNED AN AIRSPD OF 310 TO AN ACR Y, THEN 280 KTS TO ACR X. LATER THOUGHT HE HAD ASSIGNED FL280 TO ACR X THE CTLR NEVER SAID 'FL280' UNTIL HE ASKED IF WE ACKNOWLEDGED CLRNC TO 'FL280' AND WE SAID NO. ALL PARTIES SHOULD USE PROPER ATC PHRASEOLOGY TO AVOID CONFUSION.
