Narrative:

Departed montego bay jamaica (mkjs) via UG430/putul/usr/upa/A301. Upon contacting havana center we were told that we had no overflt permission. Our flight release showed a proper authorization code so I questioned the controller. This took several mins during which time another of our companies aircraft with a similar call sign came on the frequency. The havana controller came on and cleared us to FL330 from FL280. We climbed to FL330 and continued on course. A short time later the havana controller asked our altitude again and position. We reported our position (just south of usr) at FL330. She then came back and said we were not cleared into havana airspace. She also told us to climb immediately to FL350 because of conflicting traffic. Once at FL350 we responded that she had cleared us into her airspace and up to FL330. She had confused us with our company aircraft and had issued us a clearance by mistake. We discussed our overflt permission telex number and she was able to admit that we in fact did have overflt permission. Nothing more was said until we about to leave havana airspace at which time a supervisor came on the frequency and questioned us about the incident. Human factors involved in the lack of communication when 2 different languages are spoken on the same frequency and the closeness of 2 different aircraft call signs. There was also confusion regarding the overflt permission identify versus the aircraft call sign.

Title: FOREIGN CTLR QUESTIONED VALIDITY OF RPTR'S CLRNC INTO THE FOREIGN AIRSPACE. CONFUSED RPTR'S FLT WITH ANOTHER FLT OF SAME COMPANY.

Narrative: DEPARTED MONTEGO BAY JAMAICA (MKJS) VIA UG430/PUTUL/USR/UPA/A301. UPON CONTACTING HAVANA CENTER WE WERE TOLD THAT WE HAD NO OVERFLT PERMISSION. OUR FLT RELEASE SHOWED A PROPER AUTHORIZATION CODE SO I QUESTIONED THE CTLR. THIS TOOK SEVERAL MINS DURING WHICH TIME ANOTHER OF OUR COMPANIES ACFT WITH A SIMILAR CALL SIGN CAME ON THE FREQ. THE HAVANA CTLR CAME ON AND CLRED US TO FL330 FROM FL280. WE CLBED TO FL330 AND CONTINUED ON COURSE. A SHORT TIME LATER THE HAVANA CTLR ASKED OUR ALT AGAIN AND POS. WE RPTED OUR POS (JUST S OF USR) AT FL330. SHE THEN CAME BACK AND SAID WE WERE NOT CLRED INTO HAVANA AIRSPACE. SHE ALSO TOLD US TO CLB IMMEDIATELY TO FL350 BECAUSE OF CONFLICTING TFC. ONCE AT FL350 WE RESPONDED THAT SHE HAD CLRED US INTO HER AIRSPACE AND UP TO FL330. SHE HAD CONFUSED US WITH OUR COMPANY ACFT AND HAD ISSUED US A CLRNC BY MISTAKE. WE DISCUSSED OUR OVERFLT PERMISSION TELEX NUMBER AND SHE WAS ABLE TO ADMIT THAT WE IN FACT DID HAVE OVERFLT PERMISSION. NOTHING MORE WAS SAID UNTIL WE ABOUT TO LEAVE HAVANA AIRSPACE AT WHICH TIME A SUPVR CAME ON THE FREQ AND QUESTIONED US ABOUT THE INCIDENT. HUMAN FACTORS INVOLVED IN THE LACK OF COM WHEN 2 DIFFERENT LANGUAGES ARE SPOKEN ON THE SAME FREQ AND THE CLOSENESS OF 2 DIFFERENT ACFT CALL SIGNS. THERE WAS ALSO CONFUSION REGARDING THE OVERFLT PERMISSION IDENT VERSUS THE ACFT CALL SIGN.
