Narrative:

En route from lga to clt FL280. I get TCASII alert 'traffic, traffic' pick up company flight an medium large transport passing right to left as shown. It was close. Other flight gets TCASII alert. We did not get an RA. Was told by center that he was at FL290. I currently fly fighter for an ANG unit. This aircraft passed well within 1000 ft of my location. I could have easily rejoined on him. He was so close I could tell it was an medium large transport X model. Supplemental information from acn 190032: TCASII sounded 'traffic, traffic'. Our flight was level 280 as assigned and on autoplt. ATC advised traffic ahead and 1000 ft above us. The captain and I observed the company medium large transport fly past at estimated 600-800 horizontally, vertical was deceiving, but seemed less than 1000 which prompted the captain into a long discussion with ATC and is the reason I am writing this as ATC showed no conflict. Supplemental information from acn 190177: washington center had descended us from FL330 to 290. He later issued a TA at 12 O'clock at FL280. TCASII was on and operating. We got a TA on the TCASII of traffic, 900 ft with us being level at 290. The pilot of the other aircraft also reported he received a TA with a sense of urgency in his voice. We felt the TCASII advisory and the controller's advisory were perfectly normal and within the range of limitations. As the 2 aircraft passed in solid IMC. The pilot of the other aircraft called center and said, 'I fly tankers refueling aircraft, and I know that was a lot closer than 1000 ft.' the controller asked us our altitude and we reported level at 290. He asked the other aircraft's altitude and he reported level at 280. TCASII was showing 900-1000 ft vertical separation which is perfectly normal. After we were on the ground in phl and getting ready to push back for the next leg, the controller involved called the captain of my flight and asked again our altitude at the time of the conflict. He told him 290. The controller said his equipment showed us at 290 and the other aircraft at 280 and there was not a conflict. In my opinion, the other pilot does not understand TCASII. There was no conflict. There was never an RA. Supplemental information from acn 190104: at no time did he take an evasive action, and I have no idea how we could have been visible in solid IMC.

Narrative: ENRTE FROM LGA TO CLT FL280. I GET TCASII ALERT 'TFC, TFC' PICK UP COMPANY FLT AN MLG PASSING R TO L AS SHOWN. IT WAS CLOSE. OTHER FLT GETS TCASII ALERT. WE DID NOT GET AN RA. WAS TOLD BY CENTER THAT HE WAS AT FL290. I CURRENTLY FLY FIGHTER FOR AN ANG UNIT. THIS ACFT PASSED WELL WITHIN 1000 FT OF MY LOCATION. I COULD HAVE EASILY REJOINED ON HIM. HE WAS SO CLOSE I COULD TELL IT WAS AN MLG X MODEL. SUPPLEMENTAL INFO FROM ACN 190032: TCASII SOUNDED 'TFC, TFC'. OUR FLT WAS LEVEL 280 AS ASSIGNED AND ON AUTOPLT. ATC ADVISED TFC AHEAD AND 1000 FT ABOVE US. THE CAPT AND I OBSERVED THE COMPANY MLG FLY PAST AT ESTIMATED 600-800 HORIZLY, VERT WAS DECEIVING, BUT SEEMED LESS THAN 1000 WHICH PROMPTED THE CAPT INTO A LONG DISCUSSION WITH ATC AND IS THE REASON I AM WRITING THIS AS ATC SHOWED NO CONFLICT. SUPPLEMENTAL INFO FROM ACN 190177: WASHINGTON CENTER HAD DSNDED US FROM FL330 TO 290. HE LATER ISSUED A TA AT 12 O'CLOCK AT FL280. TCASII WAS ON AND OPERATING. WE GOT A TA ON THE TCASII OF TFC, 900 FT WITH US BEING LEVEL AT 290. THE PLT OF THE OTHER ACFT ALSO RPTED HE RECEIVED A TA WITH A SENSE OF URGENCY IN HIS VOICE. WE FELT THE TCASII ADVISORY AND THE CTLR'S ADVISORY WERE PERFECTLY NORMAL AND WITHIN THE RANGE OF LIMITATIONS. AS THE 2 ACFT PASSED IN SOLID IMC. THE PLT OF THE OTHER ACFT CALLED CENTER AND SAID, 'I FLY TANKERS REFUELING ACFT, AND I KNOW THAT WAS A LOT CLOSER THAN 1000 FT.' THE CTLR ASKED US OUR ALT AND WE RPTED LEVEL AT 290. HE ASKED THE OTHER ACFT'S ALT AND HE RPTED LEVEL AT 280. TCASII WAS SHOWING 900-1000 FT VERT SEPARATION WHICH IS PERFECTLY NORMAL. AFTER WE WERE ON THE GND IN PHL AND GETTING READY TO PUSH BACK FOR THE NEXT LEG, THE CTLR INVOLVED CALLED THE CAPT OF MY FLT AND ASKED AGAIN OUR ALT AT THE TIME OF THE CONFLICT. HE TOLD HIM 290. THE CTLR SAID HIS EQUIP SHOWED US AT 290 AND THE OTHER ACFT AT 280 AND THERE WAS NOT A CONFLICT. IN MY OPINION, THE OTHER PLT DOES NOT UNDERSTAND TCASII. THERE WAS NO CONFLICT. THERE WAS NEVER AN RA. SUPPLEMENTAL INFO FROM ACN 190104: AT NO TIME DID HE TAKE AN EVASIVE ACTION, AND I HAVE NO IDEA HOW WE COULD HAVE BEEN VISIBLE IN SOLID IMC.
