Narrative:

The flight was from tampa, fl, to pbi. ATIS reported runway 09L in use. We were switched to pbi approach control. They advised us to expect runway 09L. I called for the approach checklist and my first officer and I briefed the ILS approach to runway 09L. Palm beach approach cleared us for a visibility 09L approach. Approximately 3 mi final pbi approach instructed us to turn left and that we were now cleared for a visibility on runway 13. The vectors we received took us under an air carrier jet that was heading for runway 09L. Approach vectored us to final and my first officer and I just finished briefing the visibility, backed by the VOR runway 13. Palm beach approach control cleared us for the visibility approach to runway 13 and to contact palm beach tower. Pbi tower cleared us to land runway 13 and hold short of runway 09L. I informed pbi tower that we could not accept the hold short restriction as we did not review the landing data to hold short. Pbi tower's response was that if we did not accept the clearance we would have to go around because of jet traffic on final to runway 09L. I informed palm beach tower that pbi approach did not inform us of a hold short restriction so we did not review the landing data to hold short of runway 09L. Therefore, we could not accept the clearance. Pbi tower instructed us to turn left to 360 degree and climb to 1600'. I began the missed approach so my first officer and I began running the checklist. I had turned to 360 degree quickly. However, I was not sure of the altitude cleared to so I asked my first officer. He did not respond, he was working with the checklist and informing the passengers. I reduced my rate of climb and pbi tower switched us to pbi departure. Departure instructed us to turn left heading 270 degree. My first officer accepted the clearance. At that time I told my first officer that I needed an altitude and cold not turn to 270 degree due to antennas on our left that I had in sight. However, I started the turn to 310 de, that was all I could turn until we were higher. Pbi approach issued us a low altitude alert due to the antennas and to climb immediately to 1600' and turn back to 360 degree due to the antennas. I increased our rate of climb to 2000 FPM at that time we were climbing through 700'. My first officer replied that were climbing 2000 FPM. I informed my first officer that I was not changing headings as I had the antennas in sight and felt we could climb faster straight ahead. Approaching 1600', pbi departure cleared us back to 270 degree and then vectored us to the approach and landing on runway 09L. The situation was under control the entire time. However, ATC could not know that I had the antennas in sight. I did not inform the controller due to frequency congestion and time. Afterwards, it was after the fact so I did not state to ATC that I had the antennas in sight, only to my first officer. I believe that I should have just kept climbing to the approach plate missed altitude, but I was concerned of an altitude violation. The WX was VFR and I'm familiar with the palm beach area so I reduced my climb rate, so not to violate a far. I do want to make it clear that I do not believe I put my aircraft in danger nor was I careless and reckless due to the fact that I had adequate clearance with all obstacles and still climbing. My first officer and I had the situation under control. I understand ATC's concern and appreciate that level of safety.

Narrative: THE FLT WAS FROM TAMPA, FL, TO PBI. ATIS RPTED RWY 09L IN USE. WE WERE SWITCHED TO PBI APCH CTL. THEY ADVISED US TO EXPECT RWY 09L. I CALLED FOR THE APCH CHKLIST AND MY F/O AND I BRIEFED THE ILS APCH TO RWY 09L. PALM BEACH APCH CLRED US FOR A VIS 09L APCH. APPROX 3 MI FINAL PBI APCH INSTRUCTED US TO TURN L AND THAT WE WERE NOW CLRED FOR A VIS ON RWY 13. THE VECTORS WE RECEIVED TOOK US UNDER AN ACR JET THAT WAS HDG FOR RWY 09L. APCH VECTORED US TO FINAL AND MY F/O AND I JUST FINISHED BRIEFING THE VIS, BACKED BY THE VOR RWY 13. PALM BEACH APCH CTL CLRED US FOR THE VIS APCH TO RWY 13 AND TO CONTACT PALM BEACH TWR. PBI TWR CLRED US TO LAND RWY 13 AND HOLD SHORT OF RWY 09L. I INFORMED PBI TWR THAT WE COULD NOT ACCEPT THE HOLD SHORT RESTRICTION AS WE DID NOT REVIEW THE LNDG DATA TO HOLD SHORT. PBI TWR'S RESPONSE WAS THAT IF WE DID NOT ACCEPT THE CLRNC WE WOULD HAVE TO GO AROUND BECAUSE OF JET TFC ON FINAL TO RWY 09L. I INFORMED PALM BEACH TWR THAT PBI APCH DID NOT INFORM US OF A HOLD SHORT RESTRICTION SO WE DID NOT REVIEW THE LNDG DATA TO HOLD SHORT OF RWY 09L. THEREFORE, WE COULD NOT ACCEPT THE CLRNC. PBI TWR INSTRUCTED US TO TURN L TO 360 DEG AND CLB TO 1600'. I BEGAN THE MISSED APCH SO MY F/O AND I BEGAN RUNNING THE CHKLIST. I HAD TURNED TO 360 DEG QUICKLY. HOWEVER, I WAS NOT SURE OF THE ALT CLRED TO SO I ASKED MY F/O. HE DID NOT RESPOND, HE WAS WORKING WITH THE CHKLIST AND INFORMING THE PAXS. I REDUCED MY RATE OF CLB AND PBI TWR SWITCHED US TO PBI DEP. DEP INSTRUCTED US TO TURN L HDG 270 DEG. MY F/O ACCEPTED THE CLRNC. AT THAT TIME I TOLD MY F/O THAT I NEEDED AN ALT AND COLD NOT TURN TO 270 DEG DUE TO ANTENNAS ON OUR L THAT I HAD IN SIGHT. HOWEVER, I STARTED THE TURN TO 310 DE, THAT WAS ALL I COULD TURN UNTIL WE WERE HIGHER. PBI APCH ISSUED US A LOW ALT ALERT DUE TO THE ANTENNAS AND TO CLB IMMEDIATELY TO 1600' AND TURN BACK TO 360 DEG DUE TO THE ANTENNAS. I INCREASED OUR RATE OF CLB TO 2000 FPM AT THAT TIME WE WERE CLBING THROUGH 700'. MY F/O REPLIED THAT WERE CLBING 2000 FPM. I INFORMED MY F/O THAT I WAS NOT CHANGING HDGS AS I HAD THE ANTENNAS IN SIGHT AND FELT WE COULD CLB FASTER STRAIGHT AHEAD. APCHING 1600', PBI DEP CLRED US BACK TO 270 DEG AND THEN VECTORED US TO THE APCH AND LNDG ON RWY 09L. THE SITUATION WAS UNDER CTL THE ENTIRE TIME. HOWEVER, ATC COULD NOT KNOW THAT I HAD THE ANTENNAS IN SIGHT. I DID NOT INFORM THE CTLR DUE TO FREQ CONGESTION AND TIME. AFTERWARDS, IT WAS AFTER THE FACT SO I DID NOT STATE TO ATC THAT I HAD THE ANTENNAS IN SIGHT, ONLY TO MY F/O. I BELIEVE THAT I SHOULD HAVE JUST KEPT CLBING TO THE APCH PLATE MISSED ALT, BUT I WAS CONCERNED OF AN ALT VIOLATION. THE WX WAS VFR AND I'M FAMILIAR WITH THE PALM BEACH AREA SO I REDUCED MY CLB RATE, SO NOT TO VIOLATE A FAR. I DO WANT TO MAKE IT CLR THAT I DO NOT BELIEVE I PUT MY ACFT IN DANGER NOR WAS I CARELESS AND RECKLESS DUE TO THE FACT THAT I HAD ADEQUATE CLRNC WITH ALL OBSTACLES AND STILL CLBING. MY F/O AND I HAD THE SITUATION UNDER CTL. I UNDERSTAND ATC'S CONCERN AND APPRECIATE THAT LEVEL OF SAFETY.
