Narrative:

Aircraft exhibited airframe shudder on flight from sfo-sck. Crew concurred with maintenance that subsequent flight should be cancelled, and aircraft ferried to fat maintenance facility. The crew needed a wheels-up time of :30 local in order to duty off in fat within the 16 hour duty time limitation. It was evident that the wheels-up time would be after :30 local. Unsure whether the ferry flight could be conducted west/O violating rest requirements. The crew called oak FSDO and spoke to inspector, who ruled that ferry flts could be conducted outside of the duty period, as long as it was done after, not before the duty period. Aircraft was then ferried to fat west/O incident, and crew was released from service. A ferry permit was obtained before the flight.

Title: FSDO RULES THAT THE MAXIMUM DUTY PERIOD MAY BE EXCEEDED BY A FERRY FLT AS LONG AS THE FERRY FLT IS AT THE END OF THE DUTY DAY.

Narrative: ACFT EXHIBITED AIRFRAME SHUDDER ON FLT FROM SFO-SCK. CREW CONCURRED WITH MAINT THAT SUBSEQUENT FLT SHOULD BE CANCELLED, AND ACFT FERRIED TO FAT MAINT FAC. THE CREW NEEDED A WHEELS-UP TIME OF :30 LCL IN ORDER TO DUTY OFF IN FAT WITHIN THE 16 HR DUTY TIME LIMITATION. IT WAS EVIDENT THAT THE WHEELS-UP TIME WOULD BE AFTER :30 LCL. UNSURE WHETHER THE FERRY FLT COULD BE CONDUCTED W/O VIOLATING REST REQUIREMENTS. THE CREW CALLED OAK FSDO AND SPOKE TO INSPECTOR, WHO RULED THAT FERRY FLTS COULD BE CONDUCTED OUTSIDE OF THE DUTY PERIOD, AS LONG AS IT WAS DONE AFTER, NOT BEFORE THE DUTY PERIOD. ACFT WAS THEN FERRIED TO FAT W/O INCIDENT, AND CREW WAS RELEASED FROM SVC. A FERRY PERMIT WAS OBTAINED BEFORE THE FLT.
