Narrative:

We were westbound to chkpoint 48N 50W. At about 45W at FL330 on flight from cdg to mia. We received clearance to descend to FL310. No urgency was indicated. We requested FL350 and were almost immediately told by gander HF radio that center wanted us at FL310. At approximately 1MI after initial clearance to FL310 and approximately 32800', a cargo heavy transport Y passed us approximately 1 NM north enebnd at FL330. Gander center late acknowledged that the mistake had been made by gander ATC. Company officials state that our aircraft was TCASII equipped. We received no TCASII alert. If in fact our aircraft was TCASII equipped. I do not know whether the TCASII was not in the TA/RA mode, or if in TA/RA mode, whether it simply failed to function properly.

Title: ARTCC CTLR HAD WDB AT WRONG ALT FOR DIRECTION OF FLT, LATE DESCENT FOR OPPOSITE DIRECTION TRAFFIC ON OCEANIC ROUTE, LESS THAN STANDARD SEPARATION OCCURRED.

WE REQUESTED FL350 AND WERE ALMOST IMMEDIATELY TOLD BY GANDER HF RADIO THAT CENTER WANTED US AT FL310. AT APPROX 1MI AFTER INITIAL CLRNC TO FL310 AND APPROX 32800', A CARGO HVT Y PASSED US APPROX 1 NM N ENEBND AT FL330. GANDER CENTER LATE ACKNOWLEDGED THAT THE MISTAKE HAD BEEN MADE BY GANDER ATC. COMPANY OFFICIALS STATE THAT OUR ACFT WAS TCASII EQUIPPED. WE RECEIVED NO TCASII ALERT. IF IN FACT OUR ACFT WAS TCASII EQUIPPED. I DO NOT KNOW WHETHER THE TCASII WAS NOT IN THE TA/RA MODE, OR IF IN TA/RA MODE, WHETHER IT SIMPLY FAILED TO FUNCTION PROPERLY.
