Narrative:

We were cleared onto position and hold runway 22. I gave the aircraft to the first officer for takeoff, a single engine small aircraft Y was cleared to land runway 12L. Hold short runway 22 for departing traffic. Tower then cleared us for takeoff, and said traffic landing runway 12L will hold short our runway. I saw the traffic, but as we started our takeoff roll, he disappeared behind the terminal buildings. After setting power and making the 80 KT call, I rechked the traffic and fond that he was floating down the runway, but still had room to stop prior to the intersection. I had to wait a couple of seconds to break into a tower conversation to another aircraft, and asked tower to confirm that the small aircraft Y was going to hold short. Tower asked, and the small aircraft Y said, yes he could, but he continued to float at 3-4 ft altitude. We were still on a collision course when I yelled 'I've got it', firewalled the thrust levers, and rotated approximately 20 KTS earlier than our 135 KT vr. We passed directly over him (in a near stall) missing him by a couple ft. He was forced onto the runway by our wake turbulence, damaging his landing gear, but ok. He is being violated by hou tower. This happened earlier the same day as accident at lax. The time to limit small airplane - limited experience pilots at busy commercial airports is past due. We need restr access, better tower procedures and equipment now to prevent more disasters and near disasters.

Title: ACR MLG HAD TO MAKE LEAPING TKOF OVER AN SMA THAT LANDED ON CROSS RWY AND WAS UNABLE TO HOLD SHORT AS HE HAD BEEN CLEARED TO DO.

TWR THEN CLRED US FOR TKOF, AND SAID TFC LNDG RWY 12L WILL HOLD SHORT OUR RWY. I SAW THE TFC, BUT AS WE STARTED OUR TKOF ROLL, HE DISAPPEARED BEHIND THE TERMINAL BUILDINGS. AFTER SETTING PWR AND MAKING THE 80 KT CALL, I RECHKED THE TFC AND FOND THAT HE WAS FLOATING DOWN THE RWY, BUT STILL HAD ROOM TO STOP PRIOR TO THE INTXN. I HAD TO WAIT A COUPLE OF SECS TO BREAK INTO A TWR CONVERSATION TO ANOTHER ACFT, AND ASKED TWR TO CONFIRM THAT THE SMA Y WAS GOING TO HOLD SHORT.
