Narrative:

On climb out on the tus 5 departure, ATC advised us of traffic at 12 O'clock, less than 1 mi at 8500'. I looked down at my altimeter and we were approaching 8500' at a rate of 1500 FPM climb. I looked out window and saw traffic pass off left wing. Just prior to ATC pointing out traffic, a military was doing touch and goes at tus and requested an IFR clearance to phx, which I feel distracted the controller. He was asking military pilot numerous questions about his route of flight and altitude requested. I saw traffic about 10 mi prior, but assumed he was on ILS approach. We were on SID tracking well north of localizer course.

Title: CLIMBING MDT ACR HAD NMAC WITH SMA AT 8500' MSL NORTHWEST OF TUS.

Narrative: ON CLBOUT ON THE TUS 5 DEP, ATC ADVISED US OF TFC AT 12 O'CLOCK, LESS THAN 1 MI AT 8500'. I LOOKED DOWN AT MY ALTIMETER AND WE WERE APCHING 8500' AT A RATE OF 1500 FPM CLB. I LOOKED OUT WINDOW AND SAW TFC PASS OFF LEFT WING. JUST PRIOR TO ATC POINTING OUT TFC, A MIL WAS DOING TOUCH AND GOES AT TUS AND REQUESTED AN IFR CLRNC TO PHX, WHICH I FEEL DISTRACTED THE CTLR. HE WAS ASKING MIL PLT NUMEROUS QUESTIONS ABOUT HIS RTE OF FLT AND ALT REQUESTED. I SAW TFC ABOUT 10 MI PRIOR, BUT ASSUMED HE WAS ON ILS APCH. WE WERE ON SID TRACKING WELL N OF LOC COURSE.
