Narrative:

Flight plan was filed at plant city X-17 for a VFR flight to key west international with flight ending at key west airport. Flight was completed and flight plan was closed out via phone. A meeting with a client was made at key west airport to locate two sites that were to be photographed by airplane for accident investigation. A phone call to the tower at key west airport was made to schedule in the aerial photography mission in the immediate key west traffic area. This was completed successfully and to the satisfaction of the local controllers. The flight was again terminated at key west to further discuss another photo site that was to be taken. This site was approximately 95 mi to the northeast along the florida keys. A flight plan was filed from key west to tavernier (the photo site) and then back upland over the florida peninsula. The FSS did not reveal that a DVFR plan would be needed for the flight as filed. After airborne contact was made with the ATC of key west. Flight plan was activated and then at this time the FSS controller questioned as to what the time would be for penetration of the ADIZ around homestead AFB. A time estimated of 35 mins was stated, the FSS then informed me of the recent change as to the governing rule for DVFR and crossing the ADIZ. It was agreed it was a new change and would be reviewed. All along with all contact with FSS and ATC it was clearly stated as to the intentions of the flight for a photo mission at tavernier and then the flight would be rted over the gulf back over the mainland of fl. Upon penetrating the ADIZ an aircraft was contacting ATC or FSS to have me change frequencys to homestead control tower. I complied and made contact with a positive identification made by ATC. After a brief time I was informed that radar contact was lost and to go VFR. After completing the photo mission, contact was attempted numerous times with homestead, miami center, FSS all unsuccessfully. Finally contact was made with miami controllers and was given heading vectors back to our filed route of flight also with the assistance of homestead. As to any rules being broken or regulations not adhered to, I don't feel as any were broken by me, however FSS and ATC did not respond properly or assist in vectoring. The flight was completed successfully and west/O any incident. Perhaps further advance notice should have been given about the recent changes of the ADIZ and a proper review would have been made of the change. The only incident was a possible penetration of the ADIZ improperly and difficulty experienced with ATC and FSS contact. No other incident is noted.

Title: APPARENT ADIZ PENETRATION WITHOUT FILING A DVFR FLT PLAN.

Narrative: FLT PLAN WAS FILED AT PLANT CITY X-17 FOR A VFR FLT TO KEY WEST INTL WITH FLT ENDING AT KEY WEST ARPT. FLT WAS COMPLETED AND FLT PLAN WAS CLOSED OUT VIA PHONE. THIS WAS COMPLETED SUCCESSFULLY AND TO THE SATISFACTION OF THE LCL CTLRS. THE FLT WAS AGAIN TERMINATED AT KEY WEST TO FURTHER DISCUSS ANOTHER PHOTO SITE THAT WAS TO BE TAKEN. THIS SITE WAS APPROX 95 MI TO THE NE ALONG THE FLORIDA KEYS. A FLT PLAN WAS FILED FROM KEY WEST TO TAVERNIER (THE PHOTO SITE) AND THEN BACK UPLAND OVER THE FLORIDA PENINSULA. THE FSS DID NOT REVEAL THAT A DVFR PLAN WOULD BE NEEDED FOR THE FLT AS FILED. AFTER AIRBORNE CONTACT WAS MADE WITH THE ATC OF KEY WEST. FLT PLAN WAS ACTIVATED AND THEN AT THIS TIME THE FSS CTLR QUESTIONED AS TO WHAT THE TIME WOULD BE FOR PENETRATION OF THE ADIZ AROUND HOMESTEAD AFB. A TIME ESTIMATED OF 35 MINS WAS STATED, THE FSS THEN INFORMED ME OF THE RECENT CHANGE AS TO THE GOVERNING RULE FOR DVFR AND XING THE ADIZ. IT WAS AGREED IT WAS A NEW CHANGE AND WOULD BE REVIEWED. ALL ALONG WITH ALL CONTACT WITH FSS AND ATC IT WAS CLRLY STATED AS TO THE INTENTIONS OF THE FLT FOR A PHOTO MISSION AT TAVERNIER AND THEN THE FLT WOULD BE RTED OVER THE GULF BACK OVER THE MAINLAND OF FL. UPON PENETRATING THE ADIZ AN ACFT WAS CONTACTING ATC OR FSS TO HAVE ME CHANGE FREQS TO HOMESTEAD CTL TWR. I COMPLIED AND MADE CONTACT WITH A POSITIVE ID MADE BY ATC. AFTER A BRIEF TIME I WAS INFORMED THAT RADAR CONTACT WAS LOST AND TO GO VFR. AFTER COMPLETING THE PHOTO MISSION, CONTACT WAS ATTEMPTED NUMEROUS TIMES WITH HOMESTEAD, MIAMI CTR, FSS ALL UNSUCCESSFULLY. FINALLY CONTACT WAS MADE WITH MIAMI CTLRS AND WAS GIVEN HDG VECTORS BACK TO OUR FILED RTE OF FLT ALSO WITH THE ASSISTANCE OF HOMESTEAD. AS TO ANY RULES BEING BROKEN OR REGS NOT ADHERED TO, I DON'T FEEL AS ANY WERE BROKEN BY ME, HOWEVER FSS AND ATC DID NOT RESPOND PROPERLY OR ASSIST IN VECTORING. THE FLT WAS COMPLETED SUCCESSFULLY AND W/O ANY INCIDENT. PERHAPS FURTHER ADVANCE NOTICE SHOULD HAVE BEEN GIVEN ABOUT THE RECENT CHANGES OF THE ADIZ AND A PROPER REVIEW WOULD HAVE BEEN MADE OF THE CHANGE. THE ONLY INCIDENT WAS A POSSIBLE PENETRATION OF THE ADIZ IMPROPERLY AND DIFFICULTY EXPERIENCED WITH ATC AND FSS CONTACT. NO OTHER INCIDENT IS NOTED.
