Narrative:

X:45 pm engine start. Pm departed bvi heading 095 degrees. 5500' MSL en route. Unv arrival. Pm unv arrival. Pm departed unv. Climb out at 79 KIAS to 2600' MSL at 1350' AGL. Pm over state college heading 185 degrees. Pm looped city at 2600' MSL at 30 degree bank. Pm departed state college, heading 275 degrees, 6500' MSL en route. Pm arrived at bvi. Am exited aircraft and confronted by policy. Terms for arrest, drinking and flying. Am departed bvi for home. X+5 hours am blood test at hospital, negative results. Exited plane, approached by police. Asked to see my driver's license and presented it. Informed me penn state had ordered my arrest. Arrested for flying under the influence of alcohol. At police department police copied my social security # and informed me the FAA was being contacted and they would call me the following day. Driven back to bfi. Please note: the previous wkend I had flown to penn state to drop off a friend. Before landing we flew over the college at 2500' MSL to signal my friend's roommate we had arrived and to come out to the airport. When we arrived the roommate had been waiting for 10 mins. He said he saw an aircraft circling the college at a low altitude. He mistook that plane for mine and headed toward the airport. Clearly, someone else was buzzing the college that night. Callback conversation with reporter revealed the following: reporter states this experience was an absolute nightmare. Feels strongly the police were reacting to previous weekend when someone else flew low over area. Reporter has never had a drink in his life, so this was especially upsetting. Police did not check of blood alcohol. When reporter returned home his father took him to local hospital for alcohol test just to have some proof of his condition. FAA has reviewed incident and has dropped their investigation.

HE SAID HE SAW AN ACFT CIRCLING THE COLLEGE AT A LOW ALT. HE MISTOOK THAT PLANE FOR MINE AND HEADED TOWARD THE ARPT. CLEARLY, SOMEONE ELSE WAS BUZZING THE COLLEGE THAT NIGHT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR STATES THIS EXPERIENCE WAS AN ABSOLUTE NIGHTMARE. FEELS STRONGLY THE POLICE WERE REACTING TO PREVIOUS WEEKEND WHEN SOMEONE ELSE FLEW LOW OVER AREA. RPTR HAS NEVER HAD A DRINK IN HIS LIFE, SO THIS WAS ESPECIALLY UPSETTING. POLICE DID NOT CHK OF BLOOD ALCOHOL. WHEN RPTR RETURNED HOME HIS FATHER TOOK HIM TO LCL HOSPITAL FOR ALCOHOL TEST JUST TO HAVE SOME PROOF OF HIS CONDITION. FAA HAS REVIEWED INCIDENT AND HAS DROPPED THEIR INVESTIGATION.
