Narrative:

Approach called traffic 12-1 O'clock less than 1 mi. When I saw the traffic it was evasive maneuver time. Other aircraft was a maneuvering small aircraft Y flying sebnd at 4500'. I was westbound at 4500'. For the problem to be alleviated I feel that even though an aircraft is maneuvering, pilots still need to pay attention to cruising altitude rules. Other aircraft was clearly at the wrong altitude for the direction of flight.

Narrative: APCH CALLED TFC 12-1 O'CLOCK LESS THAN 1 MI. WHEN I SAW THE TFC IT WAS EVASIVE MANEUVER TIME. OTHER ACFT WAS A MANEUVERING SMA Y FLYING SEBND AT 4500'. I WAS WBND AT 4500'. FOR THE PROB TO BE ALLEVIATED I FEEL THAT EVEN THOUGH AN ACFT IS MANEUVERING, PLTS STILL NEED TO PAY ATTN TO CRUISING ALT RULES. OTHER ACFT WAS CLEARLY AT THE WRONG ALT FOR THE DIRECTION OF FLT.
