Narrative:

Cleared to lga, MUSE15, radar vectors trm, direct tnp, O28 radial 18 DME fix direct bld direct pgs direct dbl, as filed, climb to 3000', expect 37000' in 10 mins, departure frequency 128.1 squawk 7231, call for start. This was the only clearance we received before takeoff. After takeoff we complied with the clearance until after passing trn, when we were cleared direct to bld. Overhead bld at 37000', we turned right on the 094 right, to go direct to pgs. Shortly after making the turn, controller asked us what our heading was. We replied by saying 090. The controller told us to turn left., followed up by another turn further left, another 30 degrees. The control then issued a 90 degree right turn to another aircraft on the frequency. He then told us to maintain present heading and intercept J-60, and asked us why we made the right turn. I told him we were following our clearance direct to pgs. At this time he gave us a frequency change. The new controller gave me a phone number to call when we landed. Instead of waiting 4 hours until reaching our destination, lga, I called on the sky phone, and talked to the controller, mr X who was working us when the problem occurred overhead bld. He told me that his strip had us going east on J60 from bld. I read him the clearance from the told card the way it was given to us. He told me that I was wrong, and we had turned the wrong way, and I would be hearing from them. At this time I had to hang up because there was a lot of static on the sky phone. After about 10 mins we found a better frequency and called back. This time I talked to mr Y, area manager. He told me he was checking to see what the cause of the problem was, and said we should have been issued an amendment to our original clearance. Mr Y was a lot friendlier and listened to what I had to say. He said he would like some more time to check on what happened, and asked if I could call back in about 1 hour. I told him I would be glad to and hung up. After calling back an hour later, mr Y told me that someone in the tower at sna dropped the ball and failed to issue us an amendment. He also said that we had done everything properly and were not at fault. The reason for writing this letter is to express my feelings about being automatically considered guilty by the controller. I feel that, had I not had the sky phone available to me, a violation would have been filed against me, and a lawyer would have been a lot more expensive than the three sky phone calls that were made.

THIS WAS THE ONLY CLRNC WE RECEIVED BEFORE TKOF. AFTER TKOF WE COMPLIED WITH THE CLRNC UNTIL AFTER PASSING TRN, WHEN WE WERE CLRED DIRECT TO BLD. OVERHEAD BLD AT 37000', WE TURNED R ON THE 094 R, TO GO DIRECT TO PGS. SHORTLY AFTER MAKING THE TURN, CTLR ASKED US WHAT OUR HDG WAS. WE REPLIED BY SAYING 090. THE CTLR TOLD US TO TURN L., FOLLOWED UP BY ANOTHER TURN FURTHER L, ANOTHER 30 DEGS. THE CTL THEN ISSUED A 90 DEG R TURN TO ANOTHER ACFT ON THE FREQ. HE THEN TOLD US TO MAINTAIN PRESENT HDG AND INTERCEPT J-60, AND ASKED US WHY WE MADE THE R TURN. I TOLD HIM WE WERE FOLLOWING OUR CLRNC DIRECT TO PGS. AT THIS TIME HE GAVE US A FREQ CHANGE. THE NEW CTLR GAVE ME A PHONE NUMBER TO CALL WHEN WE LANDED. INSTEAD OF WAITING 4 HRS UNTIL REACHING OUR DEST, LGA, I CALLED ON THE SKY PHONE, AND TALKED TO THE CTLR, MR X WHO WAS WORKING US WHEN THE PROB OCCURRED OVERHEAD BLD. HE TOLD ME THAT HIS STRIP HAD US GOING E ON J60 FROM BLD. I READ HIM THE CLRNC FROM THE TOLD CARD THE WAY IT WAS GIVEN TO US. HE TOLD ME THAT I WAS WRONG, AND WE HAD TURNED THE WRONG WAY, AND I WOULD BE HEARING FROM THEM. AT THIS TIME I HAD TO HANG UP BECAUSE THERE WAS A LOT OF STATIC ON THE SKY PHONE. AFTER ABOUT 10 MINS WE FOUND A BETTER FREQ AND CALLED BACK. THIS TIME I TALKED TO MR Y, AREA MGR. HE TOLD ME HE WAS CHKING TO SEE WHAT THE CAUSE OF THE PROB WAS, AND SAID WE SHOULD HAVE BEEN ISSUED AN AMENDMENT TO OUR ORIGINAL CLRNC. MR Y WAS A LOT FRIENDLIER AND LISTENED TO WHAT I HAD TO SAY. HE SAID HE WOULD LIKE SOME MORE TIME TO CHK ON WHAT HAPPENED, AND ASKED IF I COULD CALL BACK IN ABOUT 1 HR. I TOLD HIM I WOULD BE GLAD TO AND HUNG UP. AFTER CALLING BACK AN HR LATER, MR Y TOLD ME THAT SOMEONE IN THE TWR AT SNA DROPPED THE BALL AND FAILED TO ISSUE US AN AMENDMENT. HE ALSO SAID THAT WE HAD DONE EVERYTHING PROPERLY AND WERE NOT AT FAULT. THE REASON FOR WRITING THIS LETTER IS TO EXPRESS MY FEELINGS ABOUT BEING AUTOMATICALLY CONSIDERED GUILTY BY THE CTLR. I FEEL THAT, HAD I NOT HAD THE SKY PHONE AVAILABLE TO ME, A VIOLATION WOULD HAVE BEEN FILED AGAINST ME, AND A LAWYER WOULD HAVE BEEN A LOT MORE EXPENSIVE THAN THE THREE SKY PHONE CALLS THAT WERE MADE.
