Narrative:

Departed bwi en route to climb. Began the majic 2 arrival per ATC instructions. No crossing restrictions or 'expect to cross' instructions were given. At approximately 58 NM ssw of lyh VOR on the 219 degree radial, ATC asked us if we were going to make mayos intersection at FL220. We replied 'no, we haven't been assigned to cross mayos at FL220.' controller assigned us a heading off of the arrival and told us to descend. Supplemental information from acn 139737: communication is designed to be 2-WAY and ATC instructions warrant a response. If we missed his instructions he would now by our lack of acknowledgement.
