Narrative:

Departing smf on fthil we were told to stay at 3000 feet (night). About 25 miles south of smf we received an RA 'monitor vertical speed.' a general aviation aircraft then passed 400 feet below and slightly to our right. Still at 3000 feet we could now see approaching terrain (yellow starting about 35 miles ahead) red tops 11;400 feet. Radio congestion was heavy and the controller seemed saturated. When I finally was able to request a climb the controller sounded surprised and gave us FL190; and then switched us to oak center. Oak gave us our requested turn away from the terrain and away from the traffic above (closest we got to the yellow was about 25 miles). Passing about FL286 we received a descend RA. The rest of the flight was uneventful.

Title: Following an SMF night departure on the FTHIL2 RNAV; the air carrier flight crew had a 3;000 feet climb clearance limit. ATC apparently forgot the flight which had a near miss and approaching terrain before a climb was issued. During the climb; a TCAS RA 'DESCEND' was received at FL286.
