Narrative:

Our clearance called for us to fly the teb 2 departure, which for runway 19 is as follows: at 800' turn right 280 degrees and climb to 1500', then upon reaching the 015 degree bearing to patterson NDB, climb and maintain 3000'. The takeoff occurred. Captain called for, 'gear up.' I selected gear up, at which time the gear handle light remained on and the 3 green lights out. Also at this same time tower apparently, according to north.Y. Departure, instructed us to climb to 5000' and turn right heading 220 degrees, instead of the published SID departure. Apparently I missed this new assignment of 220 degrees, according to north.Y. Departure control. In any case, our aircraft was turning to the 280 degree heading and upon contacting north.Y. Departure, they instructed us to make an, 'immediate left turn back to 220 degrees.' it appeared there was an aircraft on right downwind to runway 19. North.Y. Departure then asked why we were not at the 220 degree heading, and I responded that we must not have heard it. They then instructed us to call them upon arriving at our destination. We called them en route and discussed the situation. I think a solution to the problem would be for teb tower to assign these heading and altitude deviations to the SID, prior to takeoff, rather than right after takeoff. The gear problem was a distraction; what if we had lost communications or lost an engine? Right after takeoff is too critical a phase of flight to make last second commands that conflict with the SID.

Title: ACFT DID NOT COMPLY WITH ATC INSTRUCTIONS AFTER DEP.

Narrative: OUR CLRNC CALLED FOR US TO FLY THE TEB 2 DEP, WHICH FOR RWY 19 IS AS FOLLOWS: AT 800' TURN RIGHT 280 DEGS AND CLB TO 1500', THEN UPON REACHING THE 015 DEG BEARING TO PATTERSON NDB, CLB AND MAINTAIN 3000'. IN ANY CASE, OUR ACFT WAS TURNING TO THE 280 DEG HDG AND UPON CONTACTING N.Y. DEP, THEY INSTRUCTED US TO MAKE AN, 'IMMEDIATE LEFT TURN BACK TO 220 DEGS.' IT APPEARED THERE WAS AN ACFT ON RIGHT DOWNWIND TO RWY 19. N.Y. DEP THEN ASKED WHY WE WERE NOT AT THE 220 DEG HDG, AND I RESPONDED THAT WE MUST NOT HAVE HEARD IT. THEY THEN INSTRUCTED US TO CALL THEM UPON ARRIVING AT OUR DEST. WE CALLED THEM ENRTE AND DISCUSSED THE SITUATION. I THINK A SOLUTION TO THE PROB WOULD BE FOR TEB TWR TO ASSIGN THESE HDG AND ALT DEVIATIONS TO THE SID, PRIOR TO TKOF, RATHER THAN RIGHT AFTER TKOF. THE GEAR PROB WAS A DISTR; WHAT IF WE HAD LOST COMS OR LOST AN ENG? RIGHT AFTER TKOF IS TOO CRITICAL A PHASE OF FLT TO MAKE LAST SECOND COMMANDS THAT CONFLICT WITH THE SID.
