Narrative:

Our IFR clearance was left turn to 270 degree within 3 mi of andrews, climb to 3000' MSL by 8 mi of andrews AFB, md. We took off and complied with said instructions. When we were at 2700' MSL we saw the traffic above us and we leveled off. A second or two later we crossed under him. All this was during the switch from andrews tower to washington departure frequency. Upon tuning in departure, the controller asked if we had the traffic on our right side. We said yes and verified he was at 3000' MSL (our assigned altitude). Departure said yes. I relayed the aforementioned events and asked if the traffic was supposed to be there. Washington said he was a (call sign) aircraft going directly to the tower that 'got away' from approach control and no, he was not supposed to be there. Washington climbed us up, passed us off and I finally felt I should file this report so procedures could be changed so this won't happen again. If it had been IMC we would have had a midair without doubt. I switched back to departure to tell them of my intentions to file a hatr. A different controller was on at the time. He got off for a few mins. When he got back on, he told me to call upon landing. When I called, he explained what had happened and we were not at fault. I wasn't upset because everything worked out, but, I explained, we might want to look at the procedures we use and/or the altitudes we use. He asked questions of me in filling out a near midair collision report. He answered some of the questions I had about the other aircraft for the hatr. I recommend using different altitudes or a visual procedure into national.

Title: AFTER DEP, MIL MLT CAME IN CLOSE TO ANOTHER ACFT AND FILED AN NMAC.

UPON TUNING IN DEP, THE CTLR ASKED IF WE HAD THE TFC ON OUR RIGHT SIDE. WE SAID YES AND VERIFIED HE WAS AT 3000' MSL (OUR ASSIGNED ALT). DEP SAID YES. I RELAYED THE AFOREMENTIONED EVENTS AND ASKED IF THE TFC WAS SUPPOSED TO BE THERE. WASHINGTON SAID HE WAS A (CALL SIGN) ACFT GOING DIRECTLY TO THE TWR THAT 'GOT AWAY' FROM APCH CTL AND NO, HE WAS NOT SUPPOSED TO BE THERE. WASHINGTON CLIMBED US UP, PASSED US OFF AND I FINALLY FELT I SHOULD FILE THIS REPORT SO PROCS COULD BE CHANGED SO THIS WON'T HAPPEN AGAIN. IF IT HAD BEEN IMC WE WOULD HAVE HAD A MIDAIR WITHOUT DOUBT. I SWITCHED BACK TO DEP TO TELL THEM OF MY INTENTIONS TO FILE A HATR. A DIFFERENT CTLR WAS ON AT THE TIME. HE GOT OFF FOR A FEW MINS. WHEN HE GOT BACK ON, HE TOLD ME TO CALL UPON LNDG. WHEN I CALLED, HE EXPLAINED WHAT HAD HAPPENED AND WE WERE NOT AT FAULT. I WASN'T UPSET BECAUSE EVERYTHING WORKED OUT, BUT, I EXPLAINED, WE MIGHT WANT TO LOOK AT THE PROCS WE USE AND/OR THE ALTS WE USE. HE ASKED QUESTIONS OF ME IN FILLING OUT A NEAR MIDAIR COLLISION REPORT. HE ANSWERED SOME OF THE QUESTIONS I HAD ABOUT THE OTHER ACFT FOR THE HATR. I RECOMMEND USING DIFFERENT ALTS OR A VISUAL PROC INTO NATIONAL.
