Narrative:

On departure from phl runway 27L, we were cleared to 5000'. We were then cleared to climb higher and out of 2000', proceed direct mxe. First officer read back 'cleared to climb to 12000', and out of 2000', proceed direct mxe.' controller acknowledged the readback. We were then sent to ZNY. First officer checked in with ZNY out of 7500' for 12000'. ZNY acknowledged check-in. As we approached level at 12000', first officer told ZNY we were passing 11500' for 12000', when controller questioned our clearance. Controller said there was no conflict, but we were supposed to be at 10000'.

CTLR SAID THERE WAS NO CONFLICT, BUT WE WERE SUPPOSED TO BE AT 10000'.
