Narrative:

I was the captain of air carrier flight ord-btv 11/sat/89 in an large transport. This was the first leg of a 3-DAY sequence. As a line check airman I was conducting an IOE with a new first officer under appendix H training. We landed on runway 15, turned off on taxiway B, crossed runway 19 and taxied to the gate. I received a call from my company indicating that an investigation was under way by the FAA, that we were allegedly given instructions to hold short of runway 19 and that we did not comply. To the best of my and my crew's knowledge, these instructions were not received and definitely not acknowledged. Nothing was said by the burlington tower personnel concerning this while we continued our taxi to parking, or on contact with them on departure. If these instructions were in fact given, I can only surmise that the transmission was either blocked or was given while we were changing frequencys from tower to ground on our single-head VHF. When clrncs of this or any nature are issued by ATC, it is incumbent that the controller receive an acknowledgement, particularly if it has the potential of creating a conflict. Supplemental information from acn 128772: we were cleared to ramp and switch to ground control. Crossing runway 19 at bravo (also in use), noticed light aircraft on final executing a go around. Supplemental information from acn 128796: I followed normal company procedure and did not do anything until clear of the runway. A through passenger asked if it was normal practice to clear other airplanes for takeoff while we were still on the runway. I turned to the copilot to allow him to elaborate and if he saw anything. He repeated that it was not normal, that he didn't see anything. The captain returned and I conveyed our recent conversation to him. He didn't see the aircraft either. The fueler said to the crew 'boy, that was a close one...that little aircraft was on landing and almost hit your tail.' supplemental information from acn 129148: I was working local control at btv tower. An air carrier large transport had just landed on runway 15 and I instructed him to 'turn right at taxiway B, hold short of runway 19, remain this frequency.' large transport acknowledged the right turn. I then cleared an small aircraft to land on runway 19 and then turned my attention to other traffic. Even though the pilot was clearly in violation by crossing on active wry west/O clearance, I fell the incident could have been avoided had it taken the time to insist on an acknowledgement.

Title: ACR-LGT UNAUTH RWY CROSSING CAUSES CLOSE PROX WITH GA-SMA ON SHORT FINAL. SMA MADE GO AROUND CROSSING OVER THE ACR.

WE LANDED ON RWY 15, TURNED OFF ON TXWY B, CROSSED RWY 19 AND TAXIED TO THE GATE. I RECEIVED A CALL FROM MY COMPANY INDICATING THAT AN INVESTIGATION WAS UNDER WAY BY THE FAA, THAT WE WERE ALLEGEDLY GIVEN INSTRUCTIONS TO HOLD SHORT OF RWY 19 AND THAT WE DID NOT COMPLY. TO THE BEST OF MY AND MY CREW'S KNOWLEDGE, THESE INSTRUCTIONS WERE NOT RECEIVED AND DEFINITELY NOT ACKNOWLEDGED. NOTHING WAS SAID BY THE BURLINGTON TWR PERSONNEL CONCERNING THIS WHILE WE CONTINUED OUR TAXI TO PARKING, OR ON CONTACT WITH THEM ON DEP. IF THESE INSTRUCTIONS WERE IN FACT GIVEN, I CAN ONLY SURMISE THAT THE XMISSION WAS EITHER BLOCKED OR WAS GIVEN WHILE WE WERE CHANGING FREQS FROM TWR TO GND ON OUR SINGLE-HEAD VHF. WHEN CLRNCS OF THIS OR ANY NATURE ARE ISSUED BY ATC, IT IS INCUMBENT THAT THE CTLR RECEIVE AN ACKNOWLEDGEMENT, PARTICULARLY IF IT HAS THE POTENTIAL OF CREATING A CONFLICT. SUPPLEMENTAL INFO FROM ACN 128772: WE WERE CLRED TO RAMP AND SWITCH TO GND CTL. XING RWY 19 AT BRAVO (ALSO IN USE), NOTICED LIGHT ACFT ON FINAL EXECUTING A GAR. SUPPLEMENTAL INFO FROM ACN 128796: I FOLLOWED NORMAL COMPANY PROC AND DID NOT DO ANYTHING UNTIL CLR OF THE RWY. A THROUGH PAX ASKED IF IT WAS NORMAL PRACTICE TO CLR OTHER AIRPLANES FOR TKOF WHILE WE WERE STILL ON THE RWY. I TURNED TO THE COPLT TO ALLOW HIM TO ELABORATE AND IF HE SAW ANYTHING. HE REPEATED THAT IT WAS NOT NORMAL, THAT HE DIDN'T SEE ANYTHING. THE CAPT RETURNED AND I CONVEYED OUR RECENT CONVERSATION TO HIM. HE DIDN'T SEE THE ACFT EITHER. THE FUELER SAID TO THE CREW 'BOY, THAT WAS A CLOSE ONE...THAT LITTLE ACFT WAS ON LNDG AND ALMOST HIT YOUR TAIL.' SUPPLEMENTAL INFO FROM ACN 129148: I WAS WORKING LCL CTL AT BTV TWR. AN ACR LGT HAD JUST LANDED ON RWY 15 AND I INSTRUCTED HIM TO 'TURN RIGHT AT TXWY B, HOLD SHORT OF RWY 19, REMAIN THIS FREQ.' LGT ACKNOWLEDGED THE RIGHT TURN. I THEN CLRED AN SMA TO LAND ON RWY 19 AND THEN TURNED MY ATTN TO OTHER TFC. EVEN THOUGH THE PLT WAS CLEARLY IN VIOLATION BY XING ON ACTIVE WRY W/O CLRNC, I FELL THE INCIDENT COULD HAVE BEEN AVOIDED HAD IT TAKEN THE TIME TO INSIST ON AN ACKNOWLEDGEMENT.
