Narrative:

Cga X at FL370 requested FL410. There was plenty of room between him and cga Y wbound at FL390, so I climbed him. After awhile it became apparent that cga X was not going to be level in time. At this time the aircraft were approximately 3 mins apart. I asked the pilot if he could be level in a 1 1/2 mins, and he replied in the affirmative. I turned to other duties and when I turned back, I noticed a slow rate of climb. I asked the pilot his rate of climb and he said 600 FPM. I turned both aircraft, but too late to prevent the system error. At this time the pilot stated he was sorry, that he meant to be level but got distracted.

Title: CGA LTT CLIMBED THROUGH AN OCCUPIED ALT, RESULTING IN LESS THAN STANDARD SEPARATION.

Narrative: CGA X AT FL370 REQUESTED FL410. THERE WAS PLENTY OF ROOM BTWN HIM AND CGA Y WBOUND AT FL390, SO I CLBED HIM. AFTER AWHILE IT BECAME APPARENT THAT CGA X WAS NOT GOING TO BE LEVEL IN TIME. AT THIS TIME THE ACFT WERE APPROX 3 MINS APART. I ASKED THE PLT IF HE COULD BE LEVEL IN A 1 1/2 MINS, AND HE REPLIED IN THE AFFIRMATIVE. I TURNED TO OTHER DUTIES AND WHEN I TURNED BACK, I NOTICED A SLOW RATE OF CLB. I ASKED THE PLT HIS RATE OF CLB AND HE SAID 600 FPM. I TURNED BOTH ACFT, BUT TOO LATE TO PREVENT THE SYS ERROR. AT THIS TIME THE PLT STATED HE WAS SORRY, THAT HE MEANT TO BE LEVEL BUT GOT DISTRACTED.
