Narrative:

I was flying eastbound at 23,000' MSL on airway J80. I was west of the denver VOR inbound to mc cook (mck), northeast. I had just been informed by ZDV of an airline approaching me from the right going wbound. I saw that aircraft as it passed to my right. Shortly thereafter, I saw this airliner approaching me at 12 O'clock and the aircraft appeared to me to be at the same altitude as myself. I immediately disengaged the autoplt banked the aircraft to the right turning approximately 80 degree. The airliner passed to my left. About this time ZDV asked for my altitude, I informed ZDV that I had just taken evasive action to clear an airliner and I was returning to course and altitude. A short time later, ZDV said to call ZDV supervisor X. Then a short time later, ZDV called again wanting my telephone number which I gave them. Again I received another radio call requesting my name and address which I gave them. After landing at mc cook, northeast, I called ZDV and explained to mr X what had happened and that the controller had not advised me of the 12 O'clock traffic. Mr X said you need more confidence in the controller and the controller was real busy. I told mr X that when I took the evasive I was unable to talk to the controller that he was talking to someone else. From where I was sitting and what I was seeing, I felt I had no choice but to take evasive action now! I had a passenger in the right seat and he also felt that if I had not taken evasive action that we would have had a midair. If I had been advised of this traffic maybe I would not have had to take the action I did. Callback conversation with reporter revealed the following: reporter states that 12 O'clock traffic was not called, but appeared to be on a collision course at approximately 5 mi distance. He felt for safety he needed to change heading at once rather than wait until closer proximity. Safety alone was the reason for the action. Received letter from FSDO. Replied by telephone and later by letter and is awaiting any further communication. He flies as both corporate, part 91 and as part 135 pilot.

Title: CORPORATE PLT TOOK EVASIVE ACTION WHEN HE SPOTTED ACR TRAFFIC AT 12 O'CLOCK, OPPOSITE DIRECTION.

Narrative: I WAS FLYING EBND AT 23,000' MSL ON AIRWAY J80. I WAS W OF THE DENVER VOR INBND TO MC COOK (MCK), NE. I HAD JUST BEEN INFORMED BY ZDV OF AN AIRLINE APCHING ME FROM THE RIGHT GOING WBOUND. I SAW THAT ACFT AS IT PASSED TO MY RIGHT. SHORTLY THEREAFTER, I SAW THIS AIRLINER APCHING ME AT 12 O'CLOCK AND THE ACFT APPEARED TO ME TO BE AT THE SAME ALT AS MYSELF. I IMMEDIATELY DISENGAGED THE AUTOPLT BANKED THE ACFT TO THE RIGHT TURNING APPROX 80 DEG. THE AIRLINER PASSED TO MY LEFT. ABOUT THIS TIME ZDV ASKED FOR MY ALT, I INFORMED ZDV THAT I HAD JUST TAKEN EVASIVE ACTION TO CLEAR AN AIRLINER AND I WAS RETURNING TO COURSE AND ALT. A SHORT TIME LATER, ZDV SAID TO CALL ZDV SUPVR X. THEN A SHORT TIME LATER, ZDV CALLED AGAIN WANTING MY TELEPHONE NUMBER WHICH I GAVE THEM. AGAIN I RECEIVED ANOTHER RADIO CALL REQUESTING MY NAME AND ADDRESS WHICH I GAVE THEM. AFTER LNDG AT MC COOK, NE, I CALLED ZDV AND EXPLAINED TO MR X WHAT HAD HAPPENED AND THAT THE CTLR HAD NOT ADVISED ME OF THE 12 O'CLOCK TFC. MR X SAID YOU NEED MORE CONFIDENCE IN THE CTLR AND THE CTLR WAS REAL BUSY. I TOLD MR X THAT WHEN I TOOK THE EVASIVE I WAS UNABLE TO TALK TO THE CTLR THAT HE WAS TALKING TO SOMEONE ELSE. FROM WHERE I WAS SITTING AND WHAT I WAS SEEING, I FELT I HAD NO CHOICE BUT TO TAKE EVASIVE ACTION NOW! I HAD A PAX IN THE RIGHT SEAT AND HE ALSO FELT THAT IF I HAD NOT TAKEN EVASIVE ACTION THAT WE WOULD HAVE HAD A MIDAIR. IF I HAD BEEN ADVISED OF THIS TFC MAYBE I WOULD NOT HAVE HAD TO TAKE THE ACTION I DID. CALLBACK CONVERSATION WITH REPORTER REVEALED THE FOLLOWING: REPORTER STATES THAT 12 O'CLOCK TFC WAS NOT CALLED, BUT APPEARED TO BE ON A COLLISION COURSE AT APPROX 5 MI DISTANCE. HE FELT FOR SAFETY HE NEEDED TO CHANGE HDG AT ONCE RATHER THAN WAIT UNTIL CLOSER PROX. SAFETY ALONE WAS THE REASON FOR THE ACTION. RECEIVED LETTER FROM FSDO. REPLIED BY TELEPHONE AND LATER BY LETTER AND IS AWAITING ANY FURTHER COM. HE FLIES AS BOTH CORPORATE, PART 91 AND AS PART 135 PLT.
