Narrative:

Cleared from the ontario airport, ca. Clearance was the pomona two departure, daggett transition, to maintain 13,000' (later changed to maintain 5000'), maintain heading 255 degree, departure control frequency 125.5, mode 3/7302, ATIS. The incident occurred during takeoff while maintaining a heading of 255 degree. We were told to turn left and contact departure control. I started a left turn and asked the first officer to ask departure control about this left turn since our clearance originally was to maintain heading 255 degree. The first officer contacted departure control, and they informed us wrong frequency and to switch to another frequency. The first officer then contacted departure on this frequency and the controller directed us return to our first frequency (125.5). Since we now had turned to almost a downwind heading, and we were unable to verify this left turn, I elected to utilize my captain's emergency authority and continue a left turn to 255 degree, maintaining VFR, and clearing all aircraft in the area. While turning the aircraft, maintaining an outside safety watch, and directing the first officer's actions, the aircraft flew through the 5000' altitude restriction and leveled at 6100'. Departure control was then established and after vectoring we proceeded on a normal course to dayton, oh.

I STARTED A LEFT TURN AND ASKED THE F/O TO ASK DEP CTL ABOUT THIS LEFT TURN SINCE OUR CLRNC ORIGINALLY WAS TO MAINTAIN HDG 255 DEG. THE F/O CONTACTED DEP CTL, AND THEY INFORMED US WRONG FREQ AND TO SWITCH TO ANOTHER FREQ. THE F/O THEN CONTACTED DEP ON THIS FREQ AND THE CTLR DIRECTED US RETURN TO OUR FIRST FREQ (125.5). SINCE WE NOW HAD TURNED TO ALMOST A DOWNWIND HDG, AND WE WERE UNABLE TO VERIFY THIS LEFT TURN, I ELECTED TO UTILIZE MY CAPT'S EMER AUTHORITY AND CONTINUE A LEFT TURN TO 255 DEG, MAINTAINING VFR, AND CLEARING ALL ACFT IN THE AREA.
