Narrative:
Orlando departure called traffic ahead of us left to right at 3500'. When we saw the aircraft he was at our altitude and close. I turned left to avoid him. First officer said he was about 500' away. ATC was notified and questioned the other aircraft (small aircraft high wing) about his altitude--3500' and altimeter setting at 30.37. Orlando altimeter was 29.94.

Title: REPORTER ACFT HAD A NMAC WITH AN SMA THAT WAS IN CONTACT WITH ATC BUT WAS AT WRONG ALT AND WITHOUT ALT REPORTING EQUIPMENT.
Narrative: ORLANDO DEP CALLED TFC AHEAD OF US LEFT TO RIGHT AT 3500'. WHEN WE SAW THE ACFT HE WAS AT OUR ALT AND CLOSE. I TURNED LEFT TO AVOID HIM. F/O SAID HE WAS ABOUT 500' AWAY. ATC WAS NOTIFIED AND QUESTIONED THE OTHER ACFT (SMA HIGH WING) ABOUT HIS ALT--3500' AND ALTIMETER SETTING AT 30.37. ORLANDO ALTIMETER WAS 29.94.
