Narrative:

Departure clearance was as follows: flight xa cleared to oak via heading 255 degrees the pomona 2 departure as filed. Maintain 13000', expect 22000' in 10 mins, etc. We departed runway 26R and were told to fly runway heading, climb and maintain 13000'. I expedited the climb and was told to contact departure control. We did so. Departure instructed us to proceed direct pomona VOR and resume the pomona 2 departure. Shortly thereafter I was informed that the departure SID had a crossing restriction of 7000' at karyn intersection, which is 2 NM northwest of the pomona VOR. Over the VOR I was already climbing out of 8200' I was 1200' above the crossing restriction. However ATC, prior to departure, assigned 13000' and when departure asked us to resume the pomona 2 departure, the controller did not tell me to 'comply with crossing restriction' as he should have if he wanted the aircraft at 7000' over that intersection. When I hear a clearance to climb to 13000', and that clearance does not tell me to comply with crossing restrictions, my reaction is to climb to 13000' and that I do not have to comply with charted restriction unless advised. I feel the cause of this problem is poor ATC verbage. Clearance delivery should advise in a clearance to comply with crossing restrictions as they do at almost all other airports. To correct this problem, ATC should either assign the assigned altitude with the restriction, or assign the crossing restriction altitude as the initial altitude, then to climb to final altitude after the said intersection. Clearance delivery and tower tell you one thing, departure wants you to do something completely different. Corrective action was to level off at 8500' until karyn intx, which took only 10 seconds to reach at the speed we were at 250 KTS. No incursion was there this time. ATC advised us to maintain present altitude (8500') until karyn, then climb to 13000'.

SHORTLY THEREAFTER I WAS INFORMED THAT THE DEP SID HAD A XING RESTRICTION OF 7000' AT KARYN INTXN, WHICH IS 2 NM NW OF THE POMONA VOR. OVER THE VOR I WAS ALREADY CLBING OUT OF 8200' I WAS 1200' ABOVE THE XING RESTRICTION. HOWEVER ATC, PRIOR TO DEP, ASSIGNED 13000' AND WHEN DEP ASKED US TO RESUME THE POMONA 2 DEP, THE CTLR DID NOT TELL ME TO 'COMPLY WITH XING RESTRICTION' AS HE SHOULD HAVE IF HE WANTED THE ACFT AT 7000' OVER THAT INTXN. WHEN I HEAR A CLRNC TO CLB TO 13000', AND THAT CLRNC DOES NOT TELL ME TO COMPLY WITH XING RESTRICTIONS, MY REACTION IS TO CLB TO 13000' AND THAT I DO NOT HAVE TO COMPLY WITH CHARTED RESTRICTION UNLESS ADVISED. I FEEL THE CAUSE OF THIS PROB IS POOR ATC VERBAGE. CLRNC DELIVERY SHOULD ADVISE IN A CLRNC TO COMPLY WITH XING RESTRICTIONS AS THEY DO AT ALMOST ALL OTHER ARPTS. TO CORRECT THIS PROB, ATC SHOULD EITHER ASSIGN THE ASSIGNED ALT WITH THE RESTRICTION, OR ASSIGN THE XING RESTRICTION ALT AS THE INITIAL ALT, THEN TO CLB TO FINAL ALT AFTER THE SAID INTXN. CLRNC DELIVERY AND TWR TELL YOU ONE THING, DEP WANTS YOU TO DO SOMETHING COMPLETELY DIFFERENT. CORRECTIVE ACTION WAS TO LEVEL OFF AT 8500' UNTIL KARYN INTX, WHICH TOOK ONLY 10 SECS TO REACH AT THE SPD WE WERE AT 250 KTS. NO INCURSION WAS THERE THIS TIME. ATC ADVISED US TO MAINTAIN PRESENT ALT (8500') UNTIL KARYN, THEN CLB TO 13000'.
